| Entitlements | REVIEW COMPLETED | Natalie Albin October 9, 2023 Absolute Laser 1601 N Tucson Blvd, Suite 2 Tucson, AZ 85716 Subject: Medical Square PAD (PAD-44) Minor Amendment – Request to Allow for an Additional Permitted Use Dear Ms. Albin, I have reviewed your letter submitted October 20, 2023 (see attached) requesting a minor amendment to the Medical Square PAD to allow laser therapy treatment as a permitted use per the existing PAD document. The Medical Square PAD permits a full range of conventional and alternative medicine uses as well as “functional, alternative, and naturopathic medicine treatments, i.e. massage, acupuncture, homeopathy are allowed Personal Service land uses as they are complimentary to the medical office uses allowed in the Medical Square complex Your request to add a personal service use for laser skin therapy is consistent with the original intent of the Medical Square PAD codifying medical, and related personal services uses is complementary to existing medical and other personal service land uses in the PAD. A laser clinic uses licensed practitioners and medical devises under the supervision of a medical director to promote the health and wellness of an individual skin to treat their areas of concern. The Medical Square Pad allows for minor amendments to respond to the unanticipated needs of new owners or users. Modifications to permitted uses not specified in the PAD but are determined to be sufficiently similar in type and nature to those listed as permitted and do not change the overall intent of the PAD. The requested minor amendment is supported as outlined in Medical Square PAD Section III.G.3.1.a as follows: Minor Amendments – The PDSD Director may allow minor changes to the provisions set forth in the PAD, provided such changes are not in conflict with the goals as expressed in the PAD document. The following shall be considered minor changes: • Addition of new information to the PAD, maps, or text that does not change the intent of a regulation, development standard, or guideline. • Modifications to the permitted uses that may not be specifically listed in this document, but which are determined to be sufficiently similar in type and nature to those listed as permitted and do not change the overall intent of the PAD. A copy of this letter and attachment materials must be attached to any development plans. Sincerely, Kristina Swallow, Director Planning and Development Services Department Attachments: Applicant’s Request |
