August 27, 2025 Attn: Mr. Rory Juneman 5983 E Grant Rd #290 Tucson, AZ 85712 Subject: Welcome Broadway Planned Area Development (PAD-39) Minor Amendment to Modify building height and step-back requirements Dear Mr. Juneman, I have reviewed your letter dated August 14, 2025 (see attached) requesting a minor amendment to the Welcome Broadway Planned Area Development (PAD-39) to modify the bulk reduction step-back requirements according to urban design best practices. The applicant requests that the bulk reduction setbacks policy requiring building heights above 30 feet to be stepped back from the property line by 20 feet be replaced with a revised development standard allowing a proposed multifamily residential development without building step-backs below 50 feet along 12th Street and below 57 feet along Park Avenue. The intent of the modification brings the PAD into alignment with the Sunshine Mile District overlay, which allows comparable heights and setbacks in the Euclid/Park Subdistrict. The request is to support the permitting of a multifamily housing development within the PAD area which, while using the buildable area of the parcel to the greatest extent possible, is not planned to meet the allowed height of 75 feet. Rather, the proposed development will be 43 feet and four stories along 12th Street, and 56 feet and five stories along Park Avenue. The request is supported by an urban design code provision from a “city of comparable size” and is within the Sunshine Mile District overlay. The Euclid/Park Subdistrict of the Sunshine Mile District allows buildings up to four stories and 54 feet high up to the property line. By meeting design incentives, that can be increased to 75 feet and six stories. The PAD predates the Sunshine Mile Overlay by two years, which was adopted after a thorough public input process. Modifying the Gateway PAD heights and step-backs to be in alignment with the Sunshine Mile Overlay aligns with a modification request based on Urban Design Best Practices. The request has been recommended for approval by the Design Review Committee following two meetings on June 27, 2025 and July 23, 2025. The Design Review Committee unanimously approved the overall project design over the same meetings. The minor amendment request is as follows: 1. For the Park Avenue and 12th Street Frontages, from the property line and within 20 feet into the property, the building height along 12th Street shall not exceed 50 feet and the building height along Park Avenue shall not exceed 57 feet. The Welcome Broadway PAD allows for minor changes and adjustments to development standards that are in the interest of the community and do not affect health or safety issues, provided such changes are not in conflict with the goals as expressed in the PAD document. Therefore, it is determined that this minor amendment request is not in conflict with the overall intent of the Welcome Broadway PAD and is approved and supported as follows: 1) The PAD allows for adjustments to development standards that are in the interest of the community and do not affect health or safety; 2) The proposed changes to building step-backs are similar to the development standards of the surrounding Sunshine Mile Sub-District; 3) The proposed changes eliminates an unnatural step-back in the building design, enhancing the pedestrian experience through good design; and, 4) The proposed change is supported by urban design best practices. A copy of this letter and attachment materials must be attached to any development plans.
