Modification of Rezoning Condition 17.C, as approved by Mayor and Council under Rezoning Case C9-11-08 is required. Condition 17.C states in part that: “Development of the Property shall be in substantial compliance with the preliminary development plan and the following conditions agreed to with the Jefferson Park Neighborhood association:… C. Location of the trash receptacles for both the Walgreens and PAD a building as delineated on the PDP;” The process for a Major Change in Conditions is contained is UDC Section 3.5.4.B.2. The existing trash receptacle location is based on neighborhood feedback received during the rezoning process, and the Jefferson Park Neighborhood Plan. The proposed additional trash receptacle location is not compatible with the Plan or neighborhood feedback and would not be supported. Staff could support a location that is more in line with what is currently contained on the development plan and meets neighborhood concerns. Additionally, staff could not support the proposed trash location because of ongoing enforcement under case CE-VIO0624-02412. |
