Dear Ms. Wellott, I have reviewed your letter submitted March 13, 2024 (see attached) requesting a minor amendment to the Gateway Center PAD to allow Battery Energy Storage as a Renewable Energy use on the 4-acre property located at 745 North Center Drive. The Gateway Center PAD, approved in 1983, was created to guide development on a 155-acre area previously used as aggregate mining and landfills. The intent of the pad was to create a mixed-use area permitting high-intensity office and commercial uses. The subject parcel, currently undeveloped, was designated as a parking area in Development Area 3. The PAD is silent on Renewable Energy Generation land use. However, a 2008 determination determined that the allowed uses in Development Area 3 are equivalent to the C-1 Zone. As a result, Renewable Energy Generation is a permitted land use in Area 3. It is determined that your request to add a Battery Energy Storage facility as a Renewable Energy Generation land use on parcel #133-23-168D is appropriate based on the underlying C-1 zoning in Development Area 3. It is also aligned with Plan Tucson policies and goals in “The Natural Environment” and “The Built Environment” focus areas. The Gateway Center PAD allows for modification in accordance with UDC 3.5.5.J, allowing for a PDSD Director’s Decision for changes determined to be minor or administrative. A copy of this letter and attachment materials must be attached to any development plans.
