1. See comments from Davis Monthan AFB – DMAFB would not support Multi-Family Residential development in the PAD location, due to the high likelihood of noise complaints, but also the potential for more catastrophic impacts in the event of an unexpected aircraft incident.
2. Pima County Regional Flood Control has identified there is a 75-foot erosion setback from the top of the diversion channel to the south, which should be noted in setback descriptions. The description of the Tucson Diversion Channel states the flow is “Easterly.” This should be revised to correctly state the direction of flow.
3. General notes in the PAD document and future submitted plans should include “According to the Federal Aviation Administration (FAA) Notice Criteria Tool, no Notice Criteria are exceeded. Applicants are therefore not required to file FAA Form 7460. However, if the use of cranes is anticipated during development and construction activities, the applicant must file FAA Form 7460 at least 45 days in advance of such use, to provide the applicant with sufficient time to respond to any concerns identified by the FAA. Please file Form 7460 at https://oeaaa.faa.gov/oeaaa/external/portal.jsp.”
4. In the Cultural Resources section, include the following language: "If any archaeological materials are encountered during construction, all ground disturbing activities must cease in the immediate vicinity of the discovery, and the Tucson Historic Preservation Office must be contacted to assess the find."

DMAFB Planning staff has reviewed the PAD proposed and have the following comments:
The table of Permitt ed Uses it lists Multi -Family Development through a minor amendment process with consentfrom DMAFB. This will be something DMAFB would not support given the very close proximity to the end of ourrunway and even closer to our helicopter landing pads on north end of our ramp. This will more than likely resultin higher noise complaints that we already received, and increase the potenti al for more catastrophic impactswere there to be an unexpected aircraft incident.
Exhibit III.C: Concept plan shows a proposed setback but no landscape border. We would recommend a landscapeborder for more of a buff er from the base if the existi ng diversion channel landscape to be removed.
The remainder of this proposed PAD and concepts seem to be taking into considerati on the AEZ, AHZ and ADCs. Our main concern would be residenti al uses.

The Regional Flood Control District (District) has received and reviewed the request to rezone this property to a Planned Area Development. District staff has reviewed the submitted document and has the following informational comments;
1. The project is not located Federal Emergency Management Agency Special Flood Hazard Area or within mapped Pima County Regulated Riparian Habitat where the vegetation within the mapping is protected.
2. The project at the northeast corner of the property is impacted by a local floodplain as determined by the City of Tucson Arroyo Chico Basin Study. There is also a mapped regulatory wash with an associated setback of 25’ with an approximate 100-year peak discharge of less than 500 cfs. The District recommends at the time of permitting the impact from the project should be analyzed to determine no adverse impacts to 29th Street and adjacent properties.
3. This project is adjacent to the Tucson Diversion Channel. The Tucson Diversion Channel has an associated erosion hazard setback of 75’ and an approximate 100-year peak discharge of up to 5000 cfs. The Planned Area Development report states the flow in the Tucson Diversion Channel is “easterly.” This is not correct and the report should be revised to correctly state the direction of flow.
The District has full maintenance responsibility of the Tucson Diversion Channel and any impact will require review and approval from the District and from the United States Army Corp of Engineers.
4. The project boundaries does not have public easements where the Pima County Regional Flood Control District has responsibility.
Therefore, the District has no objection to this rezoning.

The Planning Unit of the Pima County Regional Wastewater Reclamation Department (PCRWRD) has reviewed the request and offers the following comments for your use. The request is to rezone the subject property located at the southeast corner of E. 29th Street and S. Swan Road to allow for the development of a commercial center. The existing sewer system consists of a 24-inch sewer interceptor line on the north side of 29th St. The property is connected to the public sewer.
For investigative approval regarding sewer service availability in the existing sewer system, the applicant will need to submit a Type I capacity request to sewer@pima.gov. The required form to request a Type I capacity investigation letter may be found at: Type I Capacity Request (PDF).
PCRWRD has no objection to the proposed rezoning but adds the following standard wastewater conditions:
REZONING CONDITIONS
Should the City of Tucson Mayor and Council be inclined to approve this rezoning, the Pima County Regional Wastewater Reclamation Department (PCRWRD) recommends the following rezoning conditions:
1. The owner(s) shall not construe any action by Pima County as a commitment to provide sewer service to any new development within the rezoning area until Pima County executes an agreement with the owner(s) to that effect.
2. The owner(s) shall obtain written documentation from the Pima County Regional Wastewater Reclamation Department (PCRWRD) stating that treatment and conveyance capacity is available for any new development within the proposed rezoning area, no more than 90 days before submitting any tentative plat, development

plan, preliminary sewer layout, sewer improvement plan, or request for building permit for review. Should treatment and / or conveyance capacity not be available at that time, the owner(s) shall enter into a written agreement addressing the option of funding, designing and constructing the necessary improvements to Pima County’s public sewerage system at his or her sole expense or cooperatively with other affected parties. All such improvements shall be designed and constructed as directed by the PCRWRD. 3. The owner(s) shall time all new development within the rezoning area to coincide with the availability of treatment and conveyance capacity in the downstream public sewerage system.
4. The owner(s) shall connect all development within the rezoning area to Pima County’s public sewer system at the location and in the manner specified by the PCRWRD in its capacity response letter and as specified by PCRWRD at the time of review of the tentative plat, development plan, preliminary sewer layout, sewer construction plan, or request for building permit.
5. The owner(s) shall fund, design and construct all off-site and on-site sewers necessary to serve the rezoning area, in the manner specified at the time of review of the tentative plat, development plan, preliminary sewer layout, sewer construction plan or request for building permit.
6. The owner(s) shall complete the construction of all necessary public and/or private sewerage facilities as required by all applicable agreements with Pima County, and all applicable regulations, including the Clean Water Act and those promulgated by ADEQ, before treatment and conveyance capacity in the downstream public sewerage system is permanently committed for any new development within the rezoning area.

The parcel address is 4710 East 29th Street and it occupies 27 acres ±. This parcel is located 100 feet southeast of the intersection of East 29th Street and South Swan Road. This parcel is located within the NE ¼ of the SW ¼ of Section 23, Township 14S, Range 14E, of the Gila and Salt River Meridian.
This parcel lies within FAA Part 77 airspace.
The Tucson Airport Authority conditionally approves the subject rezoning request contingent upon the following conditions of approval, as noted below. A) Given the wording within Section III-2 regarding the allowed uses for the PAD based on the C-3 zoning, the Signs Division Staff has one recommended rezoning condition to provide clear direction to both staff and the development team going forward; billboards shall not be allowed uses within this PAD site.

3. The Sign Standards, 7A.11.4, indicate that the underlying uses and zoning written for the PAD document shall designate the applicable sign district. Based on the planned rendering options for commercial layouts and uses, the underlying sign district for the site will be the General Business District. The sign standards of this district begin with UDC 7A.10.2. charts A and B, with sign specific criteria listed in C. This commercial sign district provides direction for both attached building sign allowances and detached sign allowances.

4. The PAD document discusses several aesthetic aspects for the buildings in section III-7. Please clarify if the PAD will provide a section on sign design criteria for signs on the buildings and freestanding signs at the property (i.e. shall consist of individual letters, with logo cabinets allowed, etc. – awning and canopy signs are encouraged for shade, etc.) or simply to defer sign allowances to the Sign Standards of the Unified Development Code.

3. The City of Tucson encourages Low Impact Design (LID) practices for storm water management as defined by the Stormwater Retention Detention Manual. The goal is to achieve the same volume of detention while attempting to mimic natural hydrologic processes and increase land available for development.
