Issue – This is a special exception land use request in the SR Suburban Ranch zone by Susan Carlson-Herdt of Solon Corporation on behalf of the property owner, City of Tucson, for the development of a 17,160 square-foot solar array under the Renewable Energy Generation land use. The special exception request is to construct the array on a portion of an approximately 14.25-acre parcel located 800 feet south and 800 feet east of the intersection of Golf Links Road and Harrison Road, located behind the Tucson Water reservoir at 2755 S Harrison Road (See case location map).

Renewable Energy Generation in the SR zone is subject to section 4.9.11.B.2, .3, .4, & .5 and 4.9.13.I of the Unified Development Code (UDC) and requires approval through the Zoning Examiner Special Exception Procedure, Sec. 3.4.3.

Planning and Development Services Recommendation – The Planning & Development Services Department recommends approval of the requested special exception land use, subject to the attached preliminary conditions.

Background Information

Existing Land Use: The project is located behind the Water Reservoir facing Harrison Road, and also behind a Library and Police Station facing Golf Links Road. The only other development in the back half of the parcel is a City of Tucson fueling station to the west of the project location.

Existing Zoning Description: Suburban Ranch (SR) – This zone provides for low density, large lot, single-family, residential development and suburban ranch uses, including agriculture uses. This zone is solely to provide comparable zoning for annexed areas and is not intended for rezoning.


Surrounding Zones and Land Uses:

North – SR, C-1, C-2; Library, Police Station
East – R-1; Single-family residential
South – R-1; Single-family residential
West – SR; City of Tucson Rauscher water reservoir

Applicant’s Request – The applicant request is for special exception approval for the Renewable Energy Generation land use on the site with associated site improvements.

The proposed use requires a Zoning Examiner Special Exception in the SR zone.

Planning Considerations – Land use policy direction for this area is provided by Plan Tucson, the Pantano East Area Plan, and the South Pantano Area Plan.

Plan Tucson: This location is within the Existing Neighborhoods building block. This project is supported for improving the provision of utilities in a sustainable manner, in a way that’s sensitive to the surrounding environment.

Pantano East Area Plan/South Pantano Area Plan: This development conforms with Plan policies, by supporting existing residential development.

Design Considerations

Land Use Compatibility – The subject site is largely undeveloped and sits behind a police station and library to the north, and the Rauscher Reservoir to the west. The only other development in the immediate project area is a single City of Tucson fueling Station.

The proposal is for one new Solar Array within a 17,160 square-foot area. This area is proposed to be screened to the east and south with CMU brick, and by chain-link fencing to the west and north. Vehicle access is proposed to connect to an alley running along the southern edge of the Reservoir Parcel and leading out to Harrison Road. The array itself is set back 328 feet from the residential use to the south, and 204 feet from the east.

Drainage/Grading – The parcel is not located within a floodplain. No significant changes to grading are proposed, and drainage patterns will remain unchanged.

Road Improvements/Vehicular Access/Circulation – Vehicle access is proposed to the alley south of the reservoir. Local traffic is not expected to be impacted by the construction or operation of the array.
Use Specific Standards – Renewable Energy Generation is allowed as a Special Exception in the Suburban Ranch zone providing it meets the criteria established in Section 4.9.11.B.2, .3, .4, & .5 of the Unified Development Code (UDC) with approval through a Zoning Examiner Special Exception Procedure, in accordance with UDC Section 3.4.3.

Staff find the proposal to be in compliance with all applicable UDC Use-Specific Standards.

Conclusion –The proposal is in compliance with the performance criteria for a Renewable Energy Generation. The request is consistent with policy direction in Plan Tucson, South Pantano Area Plan and the Pantano East Area Plan. Subject to compliance with the attached preliminary conditions, approval of the requested special exception is appropriate.

Thank you for the opportunity to comment on TP-ENT-0525-00009 – Harrison Rd – 2755 S
Harrison Rd, a request by Solon for a special exception on approximately 14.25 acres for a
solar array in Suburban Ranch (SR) zone. This solar array occupies a combined 14.25 ± acres,
is located 1,200 southeast of intersection of East Golf Links Road and South Harrison Road.
This special exception request lies within Federal Aviation Administration (FAA) Part 77
airspace.
Below is the response received from the FAA Pre-Screening Tool:
1. Based on the information you provided, you are required to file notice with the FAA. You
must submit notice at least 45 days before the start of the proposed construction or
alteration or the date an application for a construction permit is filed, whichever is
earliest.
2. Note: If you propose construction or alteration that is subject to the licensing
requirements of the Federal Communications Commission (FCC), you must submit
notice to the FAA on or before the date that an application is filed with the FCC. Visit
FCC Licensing to learn more.
The Tucson Airport Authority conditionally approves the special exception request contingent
upon the conditions of approval noted below. These conditions must be included in the future
special exception document.
Conditions of approval:
1. “As the Planned Community Development develops, each project applicant must file
FAA Form 7460 with the FAA at least 45 days before construction activities begin for
each proposed project unless the FAA staff, with the Obstruction Evaluation / Airport
Airspace Analysis (OE/AAA), provides the project applicant with written communication
that filing FAA Form 7460 is not required. It is highly recommended that the applicant file
earlier than 45 days to provide the applicant with sufficient time to respond to any
concerns identified by the FAA. Note that cranes proposed to be used onsite must also
be identified on Form 7460. Please file Form 7460 at

1. COMMENT: Per UDC 4.9.11.A.2, where a facility is not enclosed within a building, the surrounding screen shall be used as the building all for the purposes of setbacks. The chain link fence proposed along the west and north boundaries of the project do not meet the definition of a screen. A screen is defined as “an opaque barrier designed and constructed to conceal areas used for storage, refuse, mechanical equipment, parking, or delivery service loading bays from street and public view or to buffer adjacent land uses.” Either demonstrate compliance with UDC 4.9.11.A.2 by providing a wall that meets the definition of a screen, or provide a CMO waiver to modify the requirement.
