SUBJECT: REZONING – ESTABLISHMENT OF ORIGINAL CITY ZONING
PLANNING & DEVELOPMENT SERVICES REPORT
TP-ENT-0523-00022 Irvington Rd - Mission Village OCZ
Pima County SH, CB-1 to City of Tucson SH, C-1 (Ward 1)

Issue – This is an application by the City of Tucson to establish Original City Zoning on recently annexed parcels. The parcels are located on the northwest and southwest corners of the intersection of Mission Road and Irvington Road (see Case Location Map). Original City Zoning is required by Arizona Revised Statutes (ARS) Title 9-471.L and the Unified Development Code (UDC) Section 4.6.

ARS Title 9-471.L: “A city or town annexing an area shall adopt zoning classifications that permit densities and uses no greater than those permitted by the county immediately before annexation. Subsequent changes in zoning of the annexed territory shall be made according to existing procedures established by the city or town for the rezoning of land.”

UDC 4.6: “The applicable zoning standards on land annexed into the City, unless otherwise stipulated in the annexation ordinance, shall continue to be the county zoning standards applicable to the property prior to annexation until such time they are replaced by City standards. City zoning standards shall be placed on annexed land within six months of the date of annexation. Zoning standards, zones, overlay zones, and City Zoning Maps are extended to the annexed land in accordance with Section 3.4.4, Mayor and Council Special Exception Procedure.”

The established procedure is to “translate” the County Zoning in place before annexation, into the most appropriate City zoning classification. Lawful existing development will be allowed to continue. Property status regarding non- conforming uses and structures will be determined as needed on a case-by-case basis.

Applicant’s Request – Establish Original City Zoning for annexed parcels totaling approximately 13.0 acres.

Planning & Development Services Recommendation – The Planning & Development Services Department recommends approval of the SH and B-1 zoning to establish the Original City Zoning, and extension of the Major Streets and Routes designation as an Arterial Roadway, subject to the provisions of the pre-annexation development agreement between the applicant and the City of Tucson.

Background Information
The Mission Village Annexation District, consisting of approximately 13.00 acres of
real property, is located at the northwest and southwest corners of Mission and Irvington, in Ward
1 (Attachment A). The district consists of undeveloped commercial and residential property and is
within the obligated water service area for Tucson Water.

A public hearing was held January 24, 2023. At the close of the public hearing, Mayor and Council
directed staff to proceed with the annexation.

The owner of the commercial development, Mission Village Center, LLC, is proposing to build a
self-storage center and believes annexation is beneficial as it provides clarity regarding development
entitlements and process and allows a firm or developer to be considered for City of Tucson
economic development incentives.

Water service shall be provided only upon completion of the annexation. Tucson Water maintains
existing infrastructure in the area to support development. Any required improvements shall be
funded by the developer.

Annexation of vacant or mostly vacant land allows the City of Tucson to manage the plan review,
permitting, and development process. Property developed within the City is subject to permit fees,
impact fees, and construction sales tax. Owners of real property within the City may be subject to
use tax, utility tax, property tax, and commercial lease tax.

Existing Land Uses:
Primarily vacant land. There is an unfinished house on parcel 137-11-4600.
Surrounding Zones and Land Uses:
North: Zoned Pima County SH, City of Tucson SH; Vacant land, rural residential
South: Zoned Pima County SH, Pima County CB-1; Restaurant
East: Zoned City of Tucson C-1, C-2; Vacant Land across South Mission Road, an Arterial Gateway per the Major Streets and Routes overlay.
West: Zoned Pima County SH; Vacant land, rural residential

Zoning Translation with Descriptions

County Zone Zone Description City Translation Zone Description
SH Suburban Homestead SH Suburban Homestead
CB-1 Local Business Zone C-1 Commercial Zone
County MS&R Irvington Rd, Medium Volume Arterial 150ft City MS&R Irvington Road, Arterial 120ft

Planning Considerations – Plan policies are not applied to Original City Zoning. Any future rezoning request of the annexed land must be in conformance with adopted land use plans.

Conclusion – Consistent with State Statue and the Unified Development Code, the City translation Zones provided above are the most comparable to the Pima County zones, and do not permit densities and uses greater than those permitted by the county. Translation to the City zones with conditions to reflect pre-annexation and development agreements between City of Tucson and the applicant as recommended, is the appropriate translation from Pima County zoning to City of Tucson zoning.

The Planning Unit of the Pima County Regional Wastewater Reclamation Department (PCRWRD) has reviewed the submitted request and offers the following comments for your use. This is the request for the establishment of the original City of Tucson zoning district on the 13-acre property in the vicinity of Mission Rd and Irvington Rd.
The subject property is within the PCRWRD service area and is tributary to the Agua Nueva Water Reclamation Facility. Sewer service is available in the existing sewer system located nearby the property.
PCRWRD has no objections to the proposed request for the establishment of the original City zoning district.
The following standard wastewater requirements apply to all new development proposing to connect to a public sewer:
***Standard and Special Requirements***
1. The owner(s) shall not construe any action by Pima County as a commitment to provide sewer service to any new development within the project site until Pima County executes an agreement with the owner(s) to that effect.
2. The owner(s) shall obtain written documentation from the Pima County Regional Wastewater Reclamation Department (PCRWRD) stating that treatment and conveyance capacity is available for any new development within the proposed project site, no more than 90 days before submitting any tentative plat, development plan, preliminary sewer layout, sewer improvement plan, or request for building permit for review. Should treatment and / or conveyance capacity not be available at that time, the owner(s) shall enter into a written agreement addressing the option of funding, designing and constructing the necessary improvements to Pima County’s public sewerage system at his or her sole expense or cooperatively with other affected parties. All such improvements shall be designed and constructed as directed by the PCRWRD.
3. The owner(s) shall time all new development within the project site to coincide with the availability of treatment and conveyance capacity in the downstream public sewerage system.
4. The owner(s) shall connect all development within the project site to Pima County’s public sewer system at the location and in the manner specified by the PCRWRD in its capacity response letter and as specified by PCRWRD at the time of review of the tentative plat, development plan, preliminary sewer layout, sewer construction plan, or request for building permit.
5. The owner(s) shall fund, design and construct all off-site and on-site sewers necessary to serve the project site, in the manner specified at the time of review of the tentative plat, development plan, preliminary sewer layout, sewer construction plan or request for building permit.
6. The owner(s) shall complete the construction of all necessary public and/or private sewerage facilities as required by all applicable agreements with Pima County, and all applicable regulations, including the Clean Water Act and those promulgated by ADEQ, before treatment and conveyance capacity in the downstream public sewerage system is permanently committed for any new development within the project site.

Tucson Water New Area Development REVIEW COMPLETED TP-ENT-0523-00022 - Entitlement Review v1 – Original City Zoning for Mission Village Annexation District

The City of Tucson’s Water Department (Tucson Water) has no objections to the Mission Village Annexation District being annexed into the City of Tucson and rezoned from Pima County zoning CB-1 and SH to City of Tucson zoning C-1 and SH, but recommends the following conditions be added to the annexation / rezoning document(s):

1. The owner(s) / developer(s) shall time all new development within the area being rezoned to coincide with the availability of drinking water treatment, transmission, and distribution system capacity.
2. Prior to any new development within the area being rezoned, the owner(s) / developer(s) shall submit a Water Master Plan for the proposed development to Tucson Water for the purpose of determining the availability of drinking water treatment, transmission, and distribution system capacity. The Water Master Plan must quantify all potable water, irrigation water and fire suppression water demands, show the points and methods of connection to Tucson Water’s existing distribution system, and show the size and the proposed layout of the new water mains needed to serve the proposed development.
3. If the City of Tucson’s existing upstream water treatment, transmission and distribution systems are not capable of supplying the total water demand (including the demand for fire suppression water) of the proposed development on the rezoned property, the owner(s) / developer(s) shall be financially responsible for modifying and/or enhancing the existing upstream treatment, transmission and/or distribution systems to meet those needs.
4. The owner(s) / developer(s) shall construct all necessary on-site and off-site public water mains necessary to serve development within the rezoned area at their own expense.
5. The owner(s) /developer (s) shall connect all development within the rezoned area to the City of Tucson’s water distribution system at the location and in the manner specified by Tucson Water.
6. The on-site water distribution mains shall be public water mains, operated and maintained by Tucson Water.
7. Each building shall have its own water meter and water service connection line to an existing or new public water main.
8. The owner(s) / developer(s) shall design and construct all off-site and on-site water mains necessary to serve the project in the manner specified at the time of review of the Water Master Plan and Water Design Plan.
9. The owner(s) / developer(s) shall complete the construction of all necessary public water treatment, transmission, and distribution facilities as required by all applicable agreements with the City of Tucson, and all applicable regulations, including the Safe Drinking Water Act and those promulgated by ADEQ, before capacity in the upstream public water treatment, transmission and distribution system is permanently committed for any new development within the project site.
