SECTION 2-06.0.0: DEVELOPMENT PACKAGE (TENTATIVE PLATS AND SITE PLANS)

Zoning and Land Use Notes

-06.4.7.A.2 - List the gross area of the site/subdivision by square footage and acreage.

1. COMMENT: 2-06.4.7.A.2 – Per UDC Section 6.3-2, the minimum lot size for an R-1 lot is 7,000 sf. The western lot is shown to be 6,779. This will need to be increased to a minimum of 7,000 sf and the provided legal descriptions updated to reflect the change.

This comment was not addressed. The resubmittal still shows a lot below 7,000 sf, which is not permitted for an R-1 lot.

TW New Development Review REQUIRES RESUBMIT TD-DIV-1224-00095 - Land Division_Lot Split v4 – 2089 W AJO WY
Tucson Water New Area Development Section – 3rd Review on 04/01/2025

Tucson Water has the following comments regarding the proposed lot split:

1. None of my previous comments were addressed. They are reproduced below for your convenience. Some have been expanded upon.

2. Per the drawings in this submittal and Google StreetView photos, at least one the existing water meters serving the parent parcel (APN 19411570) are in an adjacent lot’s (APN 119411560’s) frontage onto the existing 6” PVC water main in Ajo Hwy. That makes at least one of the existing water meters serving the parent parcel a “remote meter” as defined in Tucson Water’s Remote Meter Policy No. IV-B.08, Eff. 07/14/2009.

3. Tucson Water’s Remote Meter Policy No. IV-B.08, states in part, “When a parcel, which does not front a Tucson Water main, wishes to connect to Tucson Water, a remote meter will not be an authorized mechanism for obtaining water.”

4. To split the parent parcel as shown on this submittal, the existing water meter(s) will have to be relocated to comply with Tucson Water’s Remote Meter Policy No. IV-B.08, Eff. 07/14/2009. This policy requires all the following:
a. Each of the existing or proposed lots to have a minimum of 15’ of real property frontage onto the usable length of an existing or new public water distribution main, and the condition of that water distribution main must be such that it can be tapped to serve the proposed lots. (The proposed lot layout meets this requirement.)
b. The public water distribution main must be within a public or private street, public alley, water easement or public utility easement granted to the City of Tucson that shares a common boundary with the existing or proposed lot. (This project meets this requirement.)
c. The water meter serving each existing or proposed lot must be located within that lot’s minimum of 15’ of real property frontage onto an existing or new public water distribution main. (THIS REQUIREMENT HAS NOT BEEN MET.)
d. The private water service line from the water meter for the existing or proposed lot to the building on the lot must not extend into any of the adjacent lots. (THIS REQUIREMENT HAS BEEN MET, BUT NOT IN AN UNACCEPTABLE MANNER. The submitted drawings show the private water service lines for both proposed lots being run in the Ajo Hwy right of way parallel to the Ajo Hwy centerline. This is not acceptable from Tucson Water’s perspective, and I doubt that is acceptable from the Arizona Department of Transportation’s perspective.)
e. The private water service line from the water meter to any building may not be located within a private water or private utility easement across an adjacent lot to the water main, as easements are not real property. (This item is for informational purposes only, to let you know that private water or private utility easement will not be acceptable.)

5. Please contact Tucson Water’s New Services Section and arrange for the relocation of the existing water meters as necessary to comply with Tucson Water’s Remote Meter Policy No. IV-B.08, Eff. 07/14/2009.

6. Documentation that arrangements have been made with Tucson Water’s New Services Section to relocate the existing water meters as necessary to comply with Tucson Water’s Remote Meter Policy No. IV-B.08, Eff. 07/14/2009, must be submitted before Tucson Water can approve the proposed lot split.

7. A revised drawing showing the relocation of the existing water meters as necessary to comply with Tucson Water’s Remote Meter Policy No. IV-B.08, Eff. 07/14/2009, and a SINGLE Comment Response Letter that addresses all the different reviewers comments is required.

8. A copy of Tucson Water’s Remote Meter Policy No. IV-B.08, Eff. 07/14/2009 may be obtained by sending an e-mail request for it to me at the e-mail address shown in my signature block.
