COMMENTS: Please resubmit revised drawings and any redlined plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is December 10, 2025.

SECTION 2-06.0.0: DEVELOPMENT PACKAGE (TENTATIVE PLATS AND SITE PLANS)

2-06.4.3 - The administrative street address and relevant case numbers (development package document, subdivision, rezoning, board of adjustment, DDO, MDR, DSMR, overlay, etc.) shall be provided adjacent to the title block on each sheet.

2-06.4.7 - General Notes
The following general notes are required. Additional notes specific to each plan are required where applicable.

Zoning and Land Use Notes

2-06.4.7.A.1 - List as a general note: "Existing zoning is ____."

2. COMMENT: 2-06.4.7.A.1 – Move General Note #8 to #1.


2-06.4.7.A.4 - Identify the existing and proposed use of the property as classified per the UDC. List all UDC sections applicable to the proposed uses.

3. COMMENT: 2-06.4.7.A.4 – Indicate proposed use of the property as a general note. It appears that it may be: Residential Use Group: Family Dwelling: Single-Family Dwelling, Detached per UDC Section 11.3.7.

The tentative plat sheet labels the structure in the southwest corner as a dwelling. No separate address nor annotation by Pima County on the property record card for this lot could be found that indicates this structure to be a dwelling. Per UDC Section 6.6.2.B, accessory structures are not permitted on a lot without a principal dwelling on it. Provide proof that this structure meets the definition of dwelling as indicated in UDC Section 11.3.7.A.


2-06.4.7.A.5 - On residential projects, list the total number of units/lots proposed.

4. COMMENT: 2-06.4.7.A.5 – Two units are annotated in the general notes, although a third – a mobile home – appears in aerial imagery from 2024.

2-06.4.9 - Information on Proposed Development
The following information on the proposed project shall be shown on the drawing or added as notes.

2-06.4.9.O - All applicable building setback lines, such as erosion hazard, floodplain detention/retention basins, and zoning, including sight visibility triangles, will be shown.

5. COMMENT: 2-06.4.9.O – The required building setbacks in an R-2 lot are 6’ or 2/3 the height of adjacent wall (whichever is greater). Without knowing the height of the dwelling walls, the minimum 6’ is still not met.

A neighbor waiver cannot be used to reduce setback requirements for dwellings (only for detached accessory structures). Remove the setback waiver language from the tentative plat sheet.

An approved Design Development Option (DDO) variance will be necessary to reduce the setback requirements to the 4.14’ shown from the Parcel B structure to the new lot line. Contact Georgia Pennington at georgia.pennington@tucsonaz.gov to request a DDO application and more information. Submit the DDO application on resubmittal.

Aerial imagery from 2024 shows a single-wide mobile home along the western property line. This is not depicted on the site plan. Per UDC Table 4.8.4, mobile homes are not permitted in R-2 zoning. No permit was found for this mobile home, which shows up in imagery around 2018, which indicates that it was approved by the City of Tucson. Proof of permit will be required or the mobile home will need to removed prior to approval of this land division.

In addition, what appears to be an extension to the existing adobe building on the southern property line was removed around 2015 and rebuilt. No permit for this work could be found. Even if the prior construction was permitted, any demolition and rebuilding would have required a new permit. None was found. In this case, since the rebuilt portion was also built with a less than one-foot setback, it would have also required a Board of Adjustment variance for approval. No proof of these were found.

Permits for this construction will need to be submitted prior to approval of this land division. For more information about a Board of Adjustment variance, contact Georgia Pennington as well.


2-06.4.9.Q - Provide the square footage and the height of each commercial, industrial, or business structure and the specific use proposed within the footprint of the building(s).

6. COMMENT: 2-06.4.9.Q – Provide height of buildings on tentative plat sheet to determine whether annotated setbacks meet the minimum requirement of 6’ or 2/3 the building height, whichever is greater.

7. COMMENT: No permits were found for additions made to the principal dwelling, which appear to include multiple patios or overhangs. Provide proof of permit, or if no, submit for permits for the additions.

Tucson Water New Area Development Section – 1st Review on 12/18/2024

Tucson Water has the following comments regarding the proposed lot split (or minor subdivision):

1. Either show the 18’ public utility easement that was granted by the Garden Homes Annex final plat recorded at Book 06, M&P, Page 54 in the Pima County Recorder’s Office, which lies partially on west side of the parent parcel OR provide documentation that this easement has been released.

2. Provide a site plan for this project that meets the City of Tucson’s residential plot plan requirements at https://www.tucsonaz.gov/files/sharedassets/public/v/1/pdsd/documents/permits/residential-permits/residential_plot_plan_requirements.pdf. This site plan will take the place of the tentative plat that was submitted. Alternatively, modify the tentative plat to meet all of the City of Tucson’s residential plot plan requirements.

3. The site plan must show all the location of the existing water meter(s) that serves the existing dwellings on the parent parcel, and the routing of the existing private water service line(s), private sewer(s) and other existing utility lines that serve those existing buildings. See Item 13 of the City of Tucson’s residential plot plan requirements.

4. The submitted final plat does not indicate who the proposed 15’ utility easement will be dedicated to. Revise as necessary.

5. A resubmittal of drawings and a comment response letter addressing the above comments must be submitted.
