1. COMMENT: Per UDC Table 6.3-4.A., the setback distance from a residential use to an adjacent residential use, updated in Ordinance 12219 is now 5’-0”. Currently, you are showing a 3’-0” distance from the existing residence to the proposed flag of the new parcel. A design development option (DDO) would need to be applied to seek relief from this setback requirement.

Know this is an extra 6-week review and the neighbors within 100’-0” are made aware of this attempt to seek relief from being in the setback. Zoning will not be able to approve this permit application until the DDO is approved. This information is linked here:

2. COMMENT: The existing 10’-0” x 10’-0” shed show 2’-0” from the south property line can be permitted by securing a neighbor setback waiver (provided below) signed and dated by the property owner to the south.

3. COMMENT: The legal descriptions that get stamped and recorded need to each be on a separate document, Parcel 1, Parcel 2. These are recorded and then the Assessor's office creates the new parcels accordingly, each requiring it's on document because this is the actual legal boundary for the parcel being created. It can't be a document showing multiple parcels unless there are easements being included as parcels.

1. Corrected land split permit
2. Provide a detailed response letter with your submittal that clearly shows how you have addressed all Zoning comments.
3. Resubmit ALL documents
4. Provide a separate supplemental site plan sheet with the two structures, setbacks and neighbor waiver for parcel 138-12-002D.
