Tucson Electric Power Company (TEP) has reviewed and approved the development
plan submitted 9/11/2023. There are existing facilities within the development which are
not depicted upon the plans; however, this is simply a lot split and there do not appear to be any apparent conflicts at this time.
Enclosed is a copy of a TEP facilities map showing the approximate location of the
existing facilities. Any relocation costs will be billable to the customer.
To apply for electric service, please call the New Construction department at (520) 918-8300. Please submit a final set of plans including approved site, electric load, paving off-site improvements and irrigation plans. If available, include a PDF version of the plans.
If easements are required, they will be secured by separate instrument. Your final

Thank you for the opportunity to comment on TD-DEV-0823-00355, a development plan for minor subdivision for 3 lots for future residential uses at 201 East Aviation Drive. This development is located in the S.W. quarter of the N.E. quarter of Section 36, Township 14S, Range 13E, of the Gila and Salt River Meridian. The development site occupies parcel number 120-06-346B, covers approximately 0.528 ± acres, and is zoned as Residence 2 Zone (R-2).
The nearest major roadway intersection is South 4th Avenue and East Aviation Drive, approximately 50 feet to the southwest of the subject development.
This site does lie within the Tucson International Airport avigation easement requirements and public disclosure area, FAA traffic pattern airspace, and FAA Part 77 airspace.
The Tucson Airport Authority is requiring a resubmit of this project. These conditions must be included in the plan documents and shall be identified in the general notes section of all future plans submitted to the City of Tucson for review.
Conditions of approval:
1. “According to the Federal Aviation Administration (FAA) Notice Criteria Tool, no Notice Criteria are exceeded. Applicants are therefore not required to file FAA Form 7460.
However, if the use of cranes is anticipated during development and construction
activities, the applicant must file FAA Form 7460 at least 45 days in advance of such
use, to provide the applicant with sufficient time to respond to any concerns identified by the FAA. Please file Form 7460 at https://oeaaa.faa.gov/oeaaa/external/portal.jsp.”
Although this project does not propose a change in plan designation or zoning the Tucson Airport Authority highly recommends the applicant add the following notes into the general notes of the revised development plan. This project is located approximately 2.75 mile northwest of Tucson International Airport and is within FAA traffic pattern airspace, an area which would be subject to aircraft overflight and noise due to being in close proximity to Tucson International Airport.
The proposed notes would provide a means of assuring that future owners and tenants of the property are aware they are in proximity an airport and further assures the continued right of the City of Tucson, Tucson Airport Authority, and all persons lawfully utilizing the Tucson International Airport the right to utilize the airspace above or near the property. This would be accomplished through the property owner recording the Avigation Easement and providing the
Airport Disclosure Statement to the new residents of all residential uses. The Tucson Airport Authority believes the proposed note helps to support the City of Tucson Airport Environs Overlay Zone and supports Plan Tucson – Regional and Global Positioning policy 4 (RG-4).
1. "That prior to the City's approval of the proposed development, the property owner must record the Avigation Easement that discloses the existence and operational
characteristics of the Tucson International Airport to future owners or tenants of the
property and further conveys the right to the public to lawfully use the airspace above the property. The Avigation Easement shall be recorded in a manner with the Pima County recorder which shall document it as having title liability. The content of such documents shall be according to the form and instructions provided.”
The current property owner or person authorized to sign on behalf of the current property owner must complete, sign, and record the Avigation Easement. Please record the Avigation Easement with the Pima County Recorder’s Office. Then send a complete copy of the recorded easement document to Tucson Airport Authority by either email (send to srobidoux@flytucson.com) or to the mailing address provided below.

2. Applicable to residential uses only
“The property owner/developer/applicant must provide the Airport Disclosure Statement form, at time of sale, to the new property owners with all new unit purchases. In the event the development of any residential uses does not involve the sale of new units but is instead offering rental residential units to the public, the new tenant of the rental unit must be provided a copy of the Airport Disclosure Statement form. The intent of the Airport Disclosure Statement form is to educate and notify the new residents that they are living near an airport. The content of such documents shall be according to the form and instructions provided.”
The property owner (for itself or its tenants) shall forward a signed copy of the Airport Disclosure Statement form to the Tucson Airport Authority within ten (10) days of signature, using the Scott Robidoux mailing address provided above.

1. On the Supplemental Plan: Tucson Water’s records indicate that there are four (4) water meter boxes at the rear of the parent parcel, two of which contain water meters and two of which do not. Show the existing water meter boxes, and show which water meter boxes contain existing water meters and which do not.

2. On the Supplemental Plan: Show the existing private water service line between each existing water meter box that contains an existing water meter and the existing building it serves.

Note: Tucson Water’s Remote Meter Policy No. IV-B.08, Eff. 07/14/2009 requires all of the following:
a) Each lot must have its own water meter.
b) The water meter for any given lot must lie within that lot’s frontage onto a public street, private street, or utility easement that contains an existing water main that can serve that lot.
c) The private water line from a water meter to building must lie on just one lot. The private water line from a water meter to a building may not encroach into, or cross a second lot, even in a private water easement. In other word, the private water line may not cross any existing or proposed lot line.

In this particular case:
d) A water meter in Lot 1’s street frontage may only serve buildings on Lot 1.
e) An existing water meter in the water easement at the rear of Lot 2 may only serve buildings on Lot 2.
f) The existing water meter in the water easement at the rear of Lot 3 may only serve buildings on Lot 3.

3. On the Supplemental Plan: Show any necessary removal/relocation of water meters or private water lines. And show any necessary new water meters.

4. On the Supplemental Plan: Show by Keynote 8 that new water service is required for proposed Lot 1.

5. On the Supplemental Plan and the Final Plat: The water easement granted to Nation City Water Co. at the rear of the property has been labeled as being 18 feet wide. But it is shown as only 18 inches wide. Provide a copy of this easement, shown in the title report as having been recorded at BK 48, Misc. Records, PG 103, and revise the drawings as necessary.

6. On the Final Plat: Show the recording information for the water easement granted to Nation City Water Co.

7. Provide a copy of the easement for water pies and /or mains and rights incident thereto, shown in the title report, as having been recorded at Book 265 Page 419. And show this easement on the final plat.

8. Please submit a comment response letter with the revised Supplemental Plan and Final Plat.

COMMENTS: Please resubmit revised drawings along a detailed response letter, which states how all Zoning Review Section comments were addressed.

This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-07. Also compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM).

Final plats, block plats, minor subdivisions, and condominium plats shall be prepared according to the requirements provided below. Hereafter referred to as “plat” or “plats.” A final plat serves as a survey document suitable for recordation of all or part of an approved tentative plat, if applicable. The final plat must conform to the approved tentative plat or site plan in lot configuration, design, and required conditions of development. The final plat, once approved, is recorded in the Pima County Recorder’s Office. The final plat is kept on file and becomes part of the permanent record for the subject site. (Am. Admin. 2-07.3.0 SUBMITTAL TIMING
Review of final plats is normally initiated after the tentative plat has been approved, unless concurrent tentative and final plat submittal has been approved by the PDSD prior to submittal. Final plats may also be submitted for review prior to the approval of a tentative if a minimum of one review of the tentative plat have occurred. In any case, submittal of the final plat prior to approval of the tentative plat is done at the applicant’s risk since changes could be required of the tentative that may affect the final plat.

2-07.4.0 FORMAT REQUIREMENTS
Plats must:
4.1 Be on a 24-inch by 36-inch sheet(s) folded to the eight and one-half inch by 11-inch format shown in Exhibit I. The plat may comprise several sheets showing various elements of required data;
4.2 Be prepared on materials that can be transferred to double-matt Mylar reverse read;
4.3 Have a two-inch margin on the left side and one-half inch margins on the remaining sides to comply with standardization requirements of state law for recorded plats;
4.4 Be drawn to a scale of no more than one inch equals 40 feet; and,
4.5 All lettering and dimensions shall be three-thirty-seconds inch in height.

2-07.5.0 CONTENT REQUIREMENTS

5.1 General

2-07.5.1.A A project-location map must be drawn in the upper right corner of the first sheet of the plat at a scale of three inches equals one mile and include the following information:


2-07.5.1.A.3 Subdivisions, arterial and collector streets, major watercourses, and railroads within the one-mile area; and,
