SECTION 2-08.0.0: LAND SPLIT 2-08.3.0 APPLICATION SUBMITTAL REQUIREMENTS 2-08.3.1 LAND SPLIT COMMENT: 2-08.3.1.A.1 – The submitted legal description creates a substandard R-2 parcel. Per UDC Table 6.3-2.A the minimum lot size is 5,000 sf. The legal description needs to include all of parcel 138-10-039B. 2-08.5.0 CONTENT REQUIREMENTS The following comments shall either be provided on the submitted plan for the land split or a separate submittal plot plan meeting the requirements of the example found at: https://www.tucsonaz.gov/Departments/Planning-Development-Services/Permits/Plan-Examples/Plot-Plan-Example. 1. This comment was not addressed correct. There is no setback dimension provided on the plan from the southernmost structure shown on parcel 138-10-039A. Setbacks are required to what appears to be a porch on this structure. Show the post supporting the porch and provide a setback dimension. You mention that a shed will be removed but nothing on the plan indicates this. Also this shed will need to be removed prior to approval of this land split. Provide photos that verify the removal of this structure. COMMENT: 2-08.5.F – Show all buildings on both parcel 138-10-039B & 138-10-039A and provide setback dimensions from the proposed lot lines to all adjacent buildings on both parcels 2. This comment was not addressed correctly. The required lot coverage shall include all vehicular use areas, measured within the outside edges of any area allocated to vehicle use, whether improved or unimproved, UDC Article 6.4.3.B.3.b. COMMENT: 2-08.5.G – Provide a lot coverage calculation for both parcel 138-10-039B & 138-10-039A that meets the requirements of UDC Article 6.4.3 and the example shown on the Residential Plot Plan Requirements found at: https://www.tucsonaz.gov/files/pdsd/forms/Residential_Plot_Plan_Requirements.pdf. The submitted documents are not consistent with each other: The submitted 235 E DELTA BUILDING LOCATIONS drawing shows the easternmost of the original three parcels as Assessor Parcel No. 13810039A. But APN 13810039A is not listed as one of the parcels in the 235 E Delta Rowe Explanation comment response letter, or in other submitted documents. The easternmost parcel appears to be referenced as APN 13810039C in some of the submitted documents and APN 13810039A. This is highly confusing. The easternmost parcel is listed as APN 13810039C on PimaMaps, and the Warrantee Deed for the sale of this lot from Fontana Avenue LLC to RLI International, LLC was recorded at Seq. No. 20242430887 on 08/30/2024. The 235 Delta Combined Legal Description .pdf references APN 13810039A, recorded in Seq No. 20221790545. The document recorded in Seq No. 20221790545 on 06/08/2022 is the Warrantee Deed for the sale of this lot from Jonathon Terry to Fontana Avenue LLC. Based on the Warrantee Deed for the sale of this lot from Fontana Avenue LL to RLI International, LLC (i.e. Seq. No. 20242430887) being recorded approximately 2 years after the Warrantee Deed for the sale of this lot from Jonathon Terry to RLI International, LLC (i.e. Seq No. 20221790545, it would appear that the correct Assessor’s Parcel No. for the easternmost parcel is APN 13810039C. Please revise your documents as necessary for consistency. 2. You appear to be combining APN 13810039D with 13810039B to form a new lot, that you will then split into 3 parcels. Please provide documentation that these two parcels have been successfully combined into a single parent parcel via an appropriate mechanism (i.e. either a minor subdivision or a parcel combination). The submitted letter from the Pima County Assessor’s office only acknowledges receipt of your consolidation request for these two parcels. 3. Please provide documentation of the land division history of the parent parcel or parcels that are to be split, as required by Section 2-08.3.3 of the City of Tucson Uniform Development Code Administrative manual. 4. Please provide a drawing showing the proposed land split that is 11” by 17” or larger, drawn to scale no less than one inch equals 20 feet; and fully dimensioned. Show the existing property lines in this drawing as solid lines, and the proposed property lines as dashed solid lines. The Assessor’s Parcel Number must be shown on this drawing for each existing lot, and proposed parcel numbers or letters must be shown for each proposed parcel. 5. Provide legal descriptions for each proposed parcels. Each of the legal desriptions must be named with the proposed parcel number or letter of the proposed parcel it describes. 6. Each of the proposed new lots (and any remaining existing lots) must have it’s own water meter, located within that lot’s frontage onto the closest public water main. And Tucson Water’s Remote Meter Policy No. IV-B.08, Eff. 07/14/2009 prohibits the private water line from a water meter to a building on one lot from lying on, or crossing, any other lot. A copy of Tucson Water’s Remote Meter Policy No. IV-B.08, Eff. 07/14/2009 may be obtained by sending an e-mail request for this policy to me at the e-mail address in my signature block. NOTE: Some relocation of the existing private water service lines between the water meters and the buildings may be necessary, and some new private water service lines may be needed. 7. To demonstrate this proposed lot split will comply with Tucson Water’s Remote Meter Policy No. IV-B.08, Eff. 07/14/2009, please submit a supplemental plot plan for this project that meets the Residential Plot Plan Requirements found at: https://www.tucsonaz.gov/files/pdsd/forms/Residential_Plot_Plan_Requirements.pdf. The supplemental plot plan must show the two existing water meters that serve APNs 13810039B and 13810039C, and any new water meters that will serve the proposed new parcels. It must also show the private water service lines from those water meters to all the existing structures on the property. 8. Please resubmit revised drawings along with a SINGLE detailed response letter, which states how all the different reviewers’ comments has been addressed.
