1. Recorder's Sequence Number Space [Admin Manual 2-07.5.3] - Revise the plat to provide a blank space SEQUENCE NO. ________ of adequate size at each location w here Sequence No. is referenced, reserved for the Pima County Recorder's Office to stamp the recording information. Confirm placement and sizing meets current Recorder's Office formatting requirements before resubmission.
2. Provide the Final Plat Subdivision case number (TD-DIV-0726-00047) adjacent to the title block on each sheet of the plan set.
3. The Certification of Survey Statement is incomplete. Revise the plat to include the surveyor of record's printed name, original signature, and registered land surveyor seal (with registration number legible) for the individual who prepared this final plat. An unsigned/unsealed certification cannot be accepted for recordation. [AM 2-07.5.9.A]
4. General Note #9 references Development Package with Drainage Report submission requirements. This is not a standard requirement for residential subdivisions of this type. Provide written justification for why this note applies to this project; if no applicable basis exists, remove the note from the plat prior to resubmission.
5. A current title report was not included with this submittal. Provide a title report (dated within the timeframe required by AM 2-07.2.1) demonstrating current ownership, easements of record, and all other encumbrances applicable to the subject property. Thank you for the opportunity to comment on TD-DIV-0726-00047, 1
st Submittal, a subdivision
for five new lots for future residential uses at 120 West Kennedy Street. This development is
located in the S.E. quarter of the N.W. quarter of Section 13, Township 14S, Range 13E, of the
Gila and Salt River Meridian. The development site occupies parcel number 117-14-517A,
covers approximately 0.66 ± acres, and is zoned as Office Zone 3 (O-3). The nearest major
roadway intersection is South Meyer Avenue and West Kennedy Street, approximately 175 feet
to the northwest of the subject development.
This site does lie within the Tucson International Airport avigation easement requirements and
public disclosure area, FAA traffic pattern airspace, and FAA Part 77 airspace.
The Tucson Airport Authority does not object to the 1st submittal of this project and is not
requiring a resubmittal of this project.
Although this project does not propose a change in plan designation or zoning the Tucson
Airport Authority highly recommends the applicant add the following notes into the general notes
of the revised development plan. This project is located approximately 5.6 miles northwest of
Tucson International Airport and is within FAA traffic pattern airspace, an area which would be
subject to aircraft overflight and noise due to being in close proximity to Tucson International
Airport.
The proposed notes would provide a means of assuring that future owners and tenants of the
property are aware they are in proximity an airport and further assures the continued right of the
City of Tucson, Tucson Airport Authority, and all persons lawfully utilizing the Tucson
International Airport the right to utilize the airspace above or near the property. This would be
accomplished through the property owner recording the Avigation Easement and providing the
Airport Disclosure Statement to the new residents of all residential uses. The Tucson Airport
Authority believes the proposed note helps to support the City of Tucson Airport Environs
Overlay Zone and supports Plan Tucson – Land Use 26.
1. "That prior to the City's approval of the proposed development, the property owner must
record the Avigation Easement that discloses the existence and operational
characteristics of the Tucson International Airport to future owners or tenants of the
property and further conveys the right to the public to lawfully use the airspace above the
property. The Avigation Easement shall be recorded in a manner with the Pima County
recorder which shall document it as having title liability. The content of such documents
shall be according to the form and instructions provided.”
The current property owner or person authorized to sign on behalf of the current property
owner must complete, sign, and record the Avigation Easement. Please record the
Avigation Easement with the Pima County Recorder’s Office. Then send a complete
copy of the recorded easement document to Tucson Airport Authority by either email
(send to srobidoux@flytucson.com) or to the mailing address provided below.
