1. (Comment) The minimum lot size for an R-2 parcel is currently 5,000 sf. However, the minimal residential density for R-2 is “15 dwelling unites per acre”, or one dwelling unit for every 2,904 sf. As such, parcel 2, with two existing dwelling units, must measure at least 5,808 sf. It currently only measures 5,711 sf.

Given the overall size of the parent lot, no adjustment can be made, as parcel 1 does not have sufficient square footage to give without itself falling below the minimum lot size of 5,000 sf.

A change to the current minimum lot size and residential density for R-2 is in discussion as part of a comprehensive “Middle Housing” code amendment package templated to come into effect on January 1, 2026.

Current drafts of these amendments, would allow parcels that meet the definition of “Middle Housing”, like this lot (2-4 dwellings on a single site), a residential density of 4 units per 4,000 sf and a minimum lot size of 4,000 sf. These currently recommended changes – if adopted – would potentially allow the current land division as proposed.

In this case, this permit could not be resubmitted and approved until any code amendments – again, only if adopted – were to come into effect in 2026 allowing for the change in residential density.

2. Measurements of Parcel 2 differ between the ALTA survey (5,011 sf) and the plat document (5,711 sf).

RESUBMITTAL OF THE FOLLOWING IS REQUIRED: Resubmit revised drawings showing residential density is not exceeded on Parcel 2.
