SECTION 2-08.0.0: LAND SPLIT

2-08.2.0 CONTENT REQUIREMENTS
1. COMMENT: 2-08.2.0 – Based on the existing legal description of parcel 118-04-1340, “SENTINEL PEAK ACRES E113.11' OF LOT 9 BLK 1” and the original Morning View Subdivision the existing parcel was split off of the original lot 9 block 1 which was created via a platting process. The proposed land splits exceeds the number of allowed splits for a property whose boundaries are fixed by a recorded plat, see UDC Article 11.4.20 definition of a Subdivision, C. A minor subdivision meeting AM 2-07 is required.

TW New Development Review REQUIRES RESUBMIT TD-DIV-0623-00072 - Land Division_Land Split_Lot Split v1 – 1622 W SAN LUIS BL

1. The proposed lot layout does not comply with Tucson Water’s Remote Meter Policy, which requires each new lot have a minimum of 15’ of real property frontage on a street, alley or easement that contains a water distribution main that can serve the buildings to be placed on those new lots. Proposed Lot 2 does not have such frontage. Easements are not considered real property.

2. To comply with Tucson Water’s Remote Meter policy:
a) Each of the proposed 3 lots will need to have its own water meter and water service line to a public water main. Split water services will not be allowed.
b) Proposed Lot 3 must obtain its water from the existing 4” PVC water main along the north edge of the parent parcel (APN 118041340), that was constructed in 1997 under PN 230-1997, as shown on this submittal.
c) Proposed Lot 2 must be a “flagpole” lot with a minimum of 15’ of real property frontage on San Luis Blvd. (Note: The actual width of the “flagpole” of proposed Lot 2 may need to be larger to accommodate the installation of all of the underground utilities that must be run from San Luis Blvd to Proposed Lots 2 & 3, and the proposed lot layout does not show gas being run to Proposed Lot 3.)
d) Proposed Lots 2 & 3 must obtain their water from the existing 6” water main constructed in San Luis Blvd. in 1973 under PN 133-1973.
e) The water meter and water service line for proposed Lot 2 must be in alignment with the “flagpole” portion of proposed Lot 2, and the private water service line for proposed Lot 2 may not encroach into proposed Lot 1
f) The water meter and water service line for proposed Lot 1 must not encroach into the “flagpole” portion of proposed Lot 2.

3. Tucson Water’s NE221413 Valve Map shows the general layout of the water mains constructed under PN 230-1997 and PN 133-1973. It may be requested from Tucson Water by sending an e-mail request to TWMapInfo@tucsonaz.gov.

4. A minor subdivision plat is required for this lot split. To provide legal access for utilities and vehicular traffic from San Luis Blvd to proposed Lot 3, the west side of proposed Lot 2 (including the full width of the “flagpole” will need to be designated as a PRIVATE INGRESS / EGRESS / UTILITY EASEMENT FOR THE BENEFIT OF LOT 3 on the minor subdivision plat. This label should also show the full width of this easement, which must be the full width of the “flagpole”

5. That portion of the 18’ wide utility easement created by City of Tucson Ordinance 5152 that lies along the north edge of proposed Lot 3 must be shown on the minor subdivision plat.

6. The minor subdivision plat must include a General Note that reads, NO PERMANENT STRUCTURES, INCLUDING WALLS AND FENCES, MAY BE CONSTRUCTED WITHIN THE EASEMENTS SHOWN ON THIS PLAN. THE OWNER OF EACH LOT SHALL INDEMNIFY ALL UTILITY COMPANIES AND TUCSON WATER AGAINST ANY AND ALL DAMAGE TO PRIVATE FACILITIES PLACED WITHIN THESE EASEMENTS.
