| External Reviewers - Tucson Airport Authority | APPROVED | April 22, 2024 Planning and Development Services City of Tucson 201 North Stone Avenue Tucson, AZ. 85701 RE: TD-DIV-0324-00028, Final Plat - Ohio-Treat, Lots 1-4 / 2801 E Ohio St, Tucson, AZ 85714, Received April 1, 2024 To whom this may concern, Thank you for the opportunity to comment on TD-DIV-0324-00028, the development plan for a four lot subdivision for four single family lots at 2801 East Ohio Street. This development is located in the N.E. quarter of the S.E. quarter of Section 32, Township 14S, Range 14E, of the Gila and Salt River Meridian. The development site occupies parcel number 132-19-050A covers approximately 0.975 ± acres, and is zoned as Residence Zone 1 (R-1). The nearest major roadway intersection is South Treat Avenue and East Ohio Street, approximately 50 feet to the southwest of the subject development. This site does lie within the Tucson International Airport avigation easement requirements and public disclosure area, FAA traffic pattern airspace, and FAA Part 77 airspace. The Tucson Airport Authority approves the proposed project and is not requiring a resubmittal. Although this project does not propose a change in plan designation or zoning the Tucson Airport Authority highly recommends the applicant add the following notes into the general notes of the revised development plan. This project is located approximately 2 ½ miles northeast of Tucson International Airport and is within FAA traffic pattern airspace, an area which would be subject to aircraft overflight and noise due to being in close proximity to Tucson International Airport. The proposed notes would provide a means of assuring that future owners and tenants of the property are aware they are in proximity an airport and further assures the continued right of the City of Tucson, Tucson Airport Authority, and all persons lawfully utilizing the Tucson International Airport the right to utilize the airspace above or near the property. This would be accomplished through the property owner recording the Avigation Easement and providing the Airport Disclosure Statement to the new residents of all residential uses. The Tucson Airport Authority believes the proposed note helps to support the City of Tucson Airport Environs Overlay Zone and supports Plan Tucson – Regional and Global Positioning policy 4 (RG-4). 1. "That prior to the City's approval of the proposed development, the property owner must record the Avigation Easement that discloses the existence and operational characteristics of the Tucson International Airport to future owners or tenants of the property and further conveys the right to the public to lawfully use the airspace above the property. The Avigation Easement shall be recorded in a manner with the Pima County recorder which shall document it as having title liability. The content of such documents shall be according to the form and instructions provided.” The current property owner or person authorized to sign on behalf of the current property owner must complete, sign, and record the Avigation Easement. Please record the Avigation Easement with the Pima County Recorder’s Office. Then send a complete copy of the recorded easement document to Tucson Airport Authority by either email (send to srobidoux@flytucson.com) or to the mailing address provided below. Scott Robidoux Manager of Planning Tucson Airport Authority 7250 South Tucson Blvd, Suite 300 Tucson, AZ 85756” 2. Applicable to residential uses only “The property owner/developer/applicant must provide the Airport Disclosure Statement form, at time of sale, to the new property owners with all new unit purchases. In the event the development of any residential uses does not involve the sale of new units but is instead offering rental residential units to the public, the new tenant of the rental unit must be provided a copy of the Airport Disclosure Statement form. The intent of the Airport Disclosure Statement form is to educate and notify the new residents that they are living near an airport. The content of such documents shall be according to the form and instructions provided.” The property owner (for itself or its tenants) shall forward a signed copy of the Airport Disclosure Statement form to the Tucson Airport Authority within ten (10) days of signature, using the Scott Robidoux mailing address provided above. Please do not hesitate to contact me if you have any questions or concerns regarding this comment letter. I can be reached by email at srobidoux@flytucson.com or by telephone at 520-573-4811. Respectfully, Scott Robidoux, C.M. |

| Commercial Plumbing | REQUIRES RESUBMIT | The proposed land split will require approval to provide a private sewer collection system to serve the four new parcels. The City of Tucson does not approve joint sewer use agreements in the case of new construction unless there are serious mitigating factors (e.g. Pima County will not allow a new sewer tap). An approved appeal to the building official is required before this land split can be approved. https://www.tucsonaz.gov/files/sharedassets/public/v/1/city-services/planning-development-services/documents/appeal_form4.pdf | |||
| External Reviewers - Pima County Wastewater (RWRD) | REQUIRES RESUBMIT | The applicant is responsible for obtaining review and approval by Pima County, for projects involving RWRD sewers, on-site wastewater treatment facilities and public water systems https://www.pima.gov/1766/Wastewater-Reclamation. The applicant must provide an Approval letter from RWRD, prior to PDSD Approving the permit. | |||
| New Services/JOC | REQUIRES RESUBMIT | TD-DIV-0324-00028 - Land Division_Subdivison v1 – 2801 E OHIO ST 1. Final Plat: Either show the easement for water pipes and mains, and rights incident thereto, as set forth in instrument recorded in Docket 1952, Page 31, or provide documentation that this water easement has been released. 2. Final plat: There is survey data for Curve C1 in the Easement Curve Table, and I do not see an easement line labeled C1. I see a right of way line labeled C1, but the survey data for that right of way line doesn’t match what is shown in the Easement Curve Table. Please revise and/or explain as necessary. 3. Utility Concept Plan: Tucson Water has not received a Water Master Plan for this project, and Tucson Water cannot approve this final plat until such time that Tucson Water has received and accepted a Water Master Plan for this project. Please note that looping the proposed new water line in Treat Avenue may be required. 4. A resubmittal of the final plat and a detailed comment response letter is required. 5. Any questions, comments or concerns about these comments may be directed to: Tim Rowe, P.E., Civil Engineer Tucson Water, New Development Section 201 N. Stone Avenue, #2-220 P.O. Box 27210 Tucson, AZ 85726-7210 (520) 837-2106 tim.rowe@tucsonaz.gov |
