COMMENT: Per UDC 6.6.2., "an accessory building shall be built only on a lot occupied by a principal building or use", and per UDC 6.6.1.A., "The use shall be incidental or secondary to the principal use and is located on the same parcel as the principal use." In this case, the proposal would create a parcel with an accessory structure, but not a principal structure. This is not permitted. 2. COMMENT: The new proposed parcel line bisects the solar canopy parking structure. Although the posts for the structure are on the northern parcel, half of the canopy extends over the new proposed southern parcel. The provided CCRs also indicate this space would not be considered "Common Area". At minimum, an aerial easement granted by the owner of the southern parcel would be required. In this case, provide a copy of the aerial easement in the next submittal. A recordation number will be required prior to final issuance. 3.
