This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also, compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM). Section 3.3.3.G.5.c UDC, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One-year Expiration date is December 05, 2023. 2-06.4.9 - Information on Proposed Development The following information on the proposed project shall be shown on the drawing or added as notes. 2-06.4.9.O - All applicable building setback lines, such as erosion hazard, floodplain detention/retention basins, and zoning, including sight visibility triangles, will be shown. 1. This comment was not addressed. The allowed 2’ overhang was not shown and no setback dimension was provided to the allowed 2’ overhang. COMMENT: 2-06.4.9.O - UDC Article 6.4.5.D.2.a.(2) a roofed structure may extend 2’into the required setback. For the proposed canopy shown along the east side of the building show the allowed 2’ overhang and provide a setback dimension from the allowed 2’ overhang to Oracles future right-of-way line. It appears that canopy will not meet the perimeter yard setback. If the canopy does not meet the required 10’ street perimeter yard setback, UDC Article 6.4.5.C.2.a, to the future property line, per UDC Article 3.11.D.1.d a Board of Adjustment for Variance will need to be submitted and approved. 2. This comment was not addressed. The allowed 2’ overhang was not shown and no setback dimension was provided to the allowed 2’ overhang. COMMENT: 2-06.4.9.O - UDC Article 6.4.5.D.2.a.(2) a roofed structure may extend 2’into the required setback. If the canopy does not meet the required 20’ street perimeter yard setback, UDC Article 6.4.5.C.2.b, to the north property line, the reduced setback can be processed in the above Variance process. Zoning acknowledges that you have applied for both a Board of Adjustment for Variance and a Design Development Option but until both processes are approved Zoning cannot approve this DP. A Board of Adjustment for Variance must be submitted and approved. If the DDO is approved, provide a copy of your decision letter with your resubmittal of TD-DEV-1222-00060. Further, provide the case number adjacent to the title block on all sheets, and include a general note stating the case number, date of approval, what was modified, and any applicable conditions of approval. Please note that a Board of Adjustment variance is still required to reduce the front street perimeter yard for the second canopy. If the variance request is granted, provide a copy of your decision letter with your resubmittal of TD-DEV-1222-00060. Further, provide the case number adjacent to the title block on all sheets, and include a general note stating the case number, date of approval, what was modified, and any applicable conditions of approval. |
