Site design including grading and drainage design, paving plan, and on-site utilities./ 7655 S Kolb Rd, Tucson, AZ 85756, Received October 26, 2023 To whom this may concern, Thank you for the opportunity to comment on TD-DEV-1023-00423, the development plan for constructing a new Tucson Police Department Annex facility at 7655 South Kolb Road. This development is located in the S.W. quarter of the N.W. quarter of Section 20, Township 15S, Range 15E, of the Gila and Salt River Meridian. The development site occupies parcel number 141-22-004W, covers approximately 4.01 ± acres, and is zoned as Rural Homestead Zone (RH). The nearest major roadway intersection is South Kolb Road and East Camino Boleadoras, approximately 200 feet to the southwest of the subject development. This site does lie within the Tucson International Airport avigation easement requirements and public disclosure area, FAA traffic pattern airspace, and FAA Part 77 airspace. Below are the responses that the Federal Aviation Administration (FAA) Notice Criteria Tool provided on the proposed project. 1) Your proposed structure exceeds an instrument approach area by 23 feet and aeronautical study is needed to determine if it will exceed a standard of subpart C of 14CFR Part 77. The FAA, in accordance with 77.9, requests that you file. 2) Your proposed structure is in proximity to a navigation facility and may impact the assurance of navigation signal reception. The FAA, in accordance with 77.9, requests that you file. 3) The FAA requests that you file The Tucson Airport Authority is requiring a resubmit of this project. These conditions must be included in the plan documents and shall be identified in the general notes section of all future plans submitted to the City of Tucson for review. Conditions of approval: 1. “According to the Federal Aviation Administration (FAA) Notice Criteria Tool, this project area is located in proximity to a navigation facility and could impact navigation signal reception and could impact an instrument approach area which requires that an FAA aeronautical study be completed. As this project develops, all applicants must file FAA Form 7460 with the FAA at least 45 days before construction activities begin unless FAA staff, with the Obstruction Evaluation / Airport Airspace Analysis (OE/AAA), provides the project applicant with written communication that filing FAA Form 7460 is not required. It is highly recommended that the applicant file earlier than 45 days to provide the applicant with sufficient time to respond to any concerns identified by the FAA. Note also that cranes to be used during all development or construction activities must also be identified with Form 7460. Please file Form 7460 at https://oeaaa.faa.gov/oeaaa/external/portal.jsp.” Although this project does not propose a change in plan designation or zoning the Tucson Airport Authority highly recommends the applicant add the following notes into the general notes of the revised development plan. This project is located approximately 4 miles northeast of Tucson International Airport and is within FAA traffic pattern airspace, an area which would be subject to aircraft overflight and noise due to being in close proximity to Tucson International Airport. The proposed notes would provide a means of assuring that future owners and tenants of the property are aware they are in proximity an airport and further assures the continued right of the City of Tucson, Tucson Airport Authority, and all persons lawfully utilizing the Tucson International Airport the right to utilize the airspace above or near the property. This would be accomplished through the property owner recording the Avigation Easement and providing the Airport Disclosure Statement to the new residents of all residential uses. The Tucson Airport Authority believes the proposed note helps to support the City of Tucson Airport Environs Overlay Zone and supports Plan Tucson – Regional and Global Positioning policy 4 (RG-4). 1. "That prior to the City's approval of the proposed development, the property owner must record the Avigation Easement that discloses the existence and operational characteristics of the Tucson International Airport to future owners or tenants of the property and further conveys the right to the public to lawfully use the airspace above the property. The Avigation Easement shall be recorded in a manner with the Pima County recorder which shall document it as having title liability. The content of such documents shall be according to the form and instructions provided.” The current property owner or person authorized to sign on behalf of the current property owner must complete, sign, and record the Avigation Easement. Please record the Avigation Easement with the Pima County Recorder’s Office. Then send a complete copy of the recorded easement document to Tucson Airport Authority by either email (send to srobidoux@flytucson.com) or to the mailing address provided below. The intent of the Airport Disclosure Statement form is to educate and notify the new residents that they are living near an airport. The content of such documents shall be according to the form and instructions provided.” The property owner (for itself or its tenants) shall forward a signed copy of the Airport Disclosure Statement form to the Tucson Airport Authority within ten (10) days of signature, using the Scott Robidoux mailing address provided above. This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also, compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM). Section 3.3.3.G.5.c UDC, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One-year Expiration date is October 19, 2024. 2-06.4.0 CONTENT REQUIREMENTS 1. COMMENT: 2-06.4.9.H.5 – Clearly demonstrate how the requirements of UDC Article 7.4.6.H.1 are met for the north end of the eastern most parking area where the pavement meets the future driveway. Also, this area will need to meet the requirements of UDC Article 7.4.6.F.4. 8. COMMENT: 2-06.4.9.H.5 – Provide access lane width dimensions at the card reader island called out under keynote 17. 9. COMMENT: 2-06.4.9.H.5.a – The vehicle parking calculation references “COMMERCIAL SERVICES” but protective services is part of the Civic Use Group. Revise the parking calculation to reflect the correct use group. 10. COMMENT: 2-06.4.9.H.5.a – The accessible vehicle parking space calculation is not correct and should be based on Table 1106.1 of the 2018 IBC or 1 space required. 11. COMMENT: 2-06.4.9.H.5.a – The wheel stop location dimension shown on detail 3/C500 is not correct. Review UDC Article 7.4.6.H.3 and provide the correct dimension. 12. COMMENT: 2-06.4.9.H.5.d – Provide the ratio used for the short-term bicycle parking requirements. 13. COMMENT: 2-06.4.9.H.5.d – The provided number of short-term bicycle spaces, 3, does not appear to be correct. Per UDC Article 7.4.9..B.2.d A single rack is designed and located to accommodate two bicycles. Based on the 2 racks shown the provided should be 4. 14. COMMENT: 2-06.4.9.H.5.d – The distance shown between the bike racks on detail 14/C501 is not correct and should be 4’, see UDC 7.4.6.b.2.f and Figure 7.4.9-C. 15. COMMENT: 2-06.4.9.H.5.d – Clearly demonstrate how the requirements of UDC Articles 7.4.9.B.1.e, 7.4.9.B.2.a are met. 16. COMMENT: 2-06.4.9.R – Provide a sidewalk along the southwest side of the building adjacent to access lane, TSM Section 7-01.4.1.B. 17. COMMENT: 2-06.4.9.R – There are four (4) vehicle parking spaces where parking vehicles are allowed to overhang the sidewalk. The sidewalk will need to be 6’-6” wide or wheel stops will need to be provided TSM Section 7-01.4.3.A & UDC Article 7.4.6.H.3. 18. COMMENT: 2-06.4.9.W - Indicate the locations and types of proposed signs (wall, free-standing, pedestal) to assure there are no conflicts with other requirements and that minimal locational requirements can be met.
