COMMENTS: Please resubmit revised drawings along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also, compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM).

Section 3.3.3.G.5.c UDC, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One-year Expiration date is October 15, 2024.

2-06.4.0 CONTENT REQUIREMENTS

1. COMMENT: 2-06.4.3 – Provide the development package case number, TD-DEV-1023-00416, adjacent to the title block on all sheets.

2-06.4.7 - General Notes
The following general notes are required. Additional notes specific to each plan are required where applicable.

2-06.4.7.A - Zoning and Land Use Notes

2. COMMENT: 2-06.4.7.A.4 – The Retail Trade use listed under General Note 2 is a use group not use, provide a use as classified per the UDC.

3. COMMENT: 2-06.4.7.A.4 – Review UDC Table 4.8-4 and provide all applicable Use Specific Standards for the existing and proposed uses. If the Billboard is to remain, identify the use and applicable Use Specific Standards.

4. COMMENT: 2-06.4.7.A.6.a - As both Speedway and Swan are designated as an Arterials on the COT MS&R Map provide a general note on the cover sheet stating “THIS PROJECT IS DESIGNED TO MEET THE OVERLAY ZONE(S) CRITERIA, UDC ARTICLE 5.4 MAJOR STREETS AND ROUTES SETBACK ZONE (MS&R)

2-06.4.7.A.8 - For development package documents provide:

5. COMMENT: 2-06.4.7.A.8.b – Remove the “GROSS FLOOR AREA PLUS LOT COVERAGE CALCUALITON” from the plan as lot coverage is not applicable (UDC Table 6.3-4.A) in the C-2 zone and the reduction in gross floor area is dealt with in the “GROSS FLOOR AREA REXPANIOSN CALCULATION ONLY”

6. COMMENT: 2-06.4.7.A.8.c – Provide a vehicle use area expansion calculation on the plan.

2-06.4.9 - Information on Proposed Development
The following information on the proposed project shall be shown on the drawing or added as notes.

7. COMMENT: 2-06.4.9.H.5 – The proposed 20’ PAAL providing access to the 90 degree vehicle parking spaces along the west side the building does not meet the minimum width requirement of 24’ see :UDC Table 7.4.6-1. A Board of Adjustment Variance will need to be submitted and approved.

8. COMMENT: 2-06.4.9.H.5 – Fully dimension the backup spur shown at the north end of the southernmost parking area, UDC Article 7.4.6.F.4.

9. COMMENT: 2-06.4.9.H.5 – The 4 vehicle parking spaces shown along the east side of the southern most vehicle use area so up on aerial photos some time after 2005. A portion of the building had been demolished. Zoning was not able to find approved permit documents for these parking spaces. Per UDC Article 7.4.6.K alley access is not allowed. Either provide approved permit documents or a Board of Adjustment Variance will be required.

10. COMMENT: 2-06.4.9.H.5 – Clearly demonstrate that the requirement of UDC Article 4.9.4.G.2 & 7.4.6.C.4 is met for the area around the existing billboard.

11. COMMENT: 2-06.4.9.H.5.a – The required number of vehicle parking spaces for the “RETAIL TRADE” use is not correct. Per UDC Article 7.4.3.G the number of required spaces should be 5.

12. COMMENT: 2-06.4.9.R – Until comment 6 is addressed Zoning cannot determine if TSM Section 7-01.2.0.2 applies.

13. COMMENT: 2-06.4.9.R – The sidewalk shown located under the existing billboard does not meet the requirements of UDC Article 4.9.4.G.1. A Board of Adjustment Variance will be required.

14. COMMENT: 2-06.4.9.R – As parking vehicles are allowed to overhang the sidewalk along the west side of the building clearly demonstrate that a parking vehicle will not reduce the sidewalk width to less than 4’-0”, TSM Section 701.4.3.A.

15. COMMENT: 2-06.4.9.R - Until comment 6 is addressed Zoning cannot determine if TSM Section 7-01.4.1.A applies.

16. COMMENT: 2-06.4.9.R – It is not clear how access is provided from the accessible vehicle parking spaces to the sidewalk. There appears to be a ramp but no spot elevations or slopes have been provided.
