COMMENTS: Please resubmit revised drawings and any redlined plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

This plan has been reviewed for compliance with the Unified Development Code (UDC), Administrative Manual (AM) Section 2-06, and the Technical Standards Manual (TSM).

Per UDC Section 3.3.3.G.5.c, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year expiration date is September 26, 2024.

1. COMMENT: 2-06.4.1 – Provide the email address and phone number of the primary property owner on the site plan.

2. COMMENT: 2-06.4.3 – Add the development case number, TD-DEV-0923-00394, adjacent to the title block on all sheets.

3. COMMENT: 2-06.4.7.A.2 – State the gross area of the entire site by square footage and acreage. Refer to UDC Section 11.4.20 for the definition of “Site.”

4. COMMENT: 2-06.4.7.A.6.a – Provide a general note stating “THIS PROJECT IS DESIGNED TO MEET THE OVERLAY ZONE CRITERIA OF UDC SEC. 5.4, MAJOR STREETS AND ROUTES (MS&R) SETBACK ZONE.”

5. COMMENT: 2-06.4.7.A.8.a – Include the “portable storage container” within the “building area” calculations. Refer to UDC Section 11.4.8 for the definition of “Gross Floor Area.”

6. COMMENT: 2-06.4.7.A.8.d – As the property is part of a larger site, provide an expansion calculation of building area for the entire site. Refer to UDC Section 11.4.20 for the definition of “Site.”

7. COMMENT: 2-06.4.8.B – Ensure all easements are depicted on the site plan. Provide the recordation information, location, width, and purpose of all existing easements.

8. COMMENT: 2-06.4.8.C – Provide the right-of-way width and recordation data of all adjacent rights-of-way on the site plan.

9. COMMENT: 2-06.4.9.F - The existing zoning classification across Silverbell Road is incorrect and should be listed as “C-1.”

10. COMMENT: 2-06.4.9.H.5 – Ensure a setback of at least one foot is provided between the existing drive-thru lane and the proposed addition (UDC 7.4.6.F.2.a.(1)).

11. COMMENT: 2-06.4.9.H.5.a – Demonstrate how the enclosure requirement for trash and recycling is being modified to reduce the number of motor vehicle parking spaces provided (UDC 7.4.7.F.7).

12. COMMENT: 2-06.4.9.H.5.a – As the site is within a shopping center, the existing and proposed Food Service use may follow a parking formula of one space per 300 square feet of gross floor area. Demonstrate that no more than 50% of the floor area of the shopping center is dedicated to uses with a parking formula of one space per 100 square feet of gross floor area or a more intense formula (UDC 11.3.9.C.3).

13. COMMENT: 2-06.4.9.H.5.d – Correct the calculation for the number of required short-term bicycle parking spaces to include the portable storage container.

14. COMMENT: 2-06.4.9.H.5.d – Demonstrate that the proposed short-term bicycle parking does not impede on-site pedestrian access. A clearance space of at least four feet in width must be provided for pedestrian access (UDC 7.4.9.B.1.a).

15. COMMENT: 2-06.4.9.H.5.d – Show how the short-term bicycle parking facilities are thoroughly illuminated during hours of use.

16. COMMENT: 2-06.4.9.O – The setbacks depicted along Speedway Boulevard and Silverbell Road are incorrect. The Mayor and Council effectuated several changes to the UDC in April. Per UDC 6.4.5.C.2.a, for nonresidential development abutting an arterial or collector street, the minimum required street perimeter yard is ten feet, as measured from the existing or future property line as determined by the adopted Major Streets and Routes Plan, whichever is greater.

17. COMMENT: A separate Commercial Demolition Permit is required to demolish the existing covered patio on the site.
