Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is September 19, 2025. SECTION 2-06.0.0: DEVELOPMENT PACKAGE (TENTATIVE PLATS AND SITE PLANS) 2-06.4.9.O - All applicable building setback lines, such as erosion hazard, floodplain detention/retention basins, and zoning, including sight visibility triangles, will be shown. 1. COMMENT: 2-06.4.9.O – The minimum required setback to adjacent residential parcels is either 6’ or 2/3 the height of the adjacent structure’s wall height, whichever is greater. The carport awning (Key Note 3) indicates posts. The height of the carport is not clear. Is the height the same as the main dwelling (17.9’)? If so, then 2/3 of 17.9’ is 11.8’, which is greater than the 6’ setback currently shown. A Design Development Option (DDO) would be required to permit this reduced setback. If the height of the carport is not 17.9’, clarify its height as measured from design grade to the flat roof, or in the case of gabled roof, the midpoint between ridge and eave. If 2/3 of this measurement is still greater than the 6’ setback depicted, then either a greater setback or a DDO will be required. Provide clear setback dimensions from each structure, including the carports, to the adjacent property lines. Physical separation – in the form of walls, fences, or landscape screening – between the flags of each parcel and the adjoining parcels in order to clearly demonstrate that each parcel functions independently without sharing access. 2-06.4.9.Q - Provide the square footage and the height of each commercial, industrial, or business structure and the specific use proposed within the footprint of the building(s). 2.
