Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is July 21, 2026. SECTION 2-06.0.0: DEVELOPMENT PACKAGE (TENTATIVE PLATS AND SITE PLANS) 1. Previous Comment 2: Draw and dimension setbacks from all existing and proposed structures to all applicable lot lines. To confirm setbacks, provide the wall height of each structure within the footprint of the building(s). **Follow-Up to Previous Comment 2: This comment was not fully addressed. Provide exact setback dimensions from all existing and proposed structures, as measured from the outside wall of each structure to all applicable lot lines. Remove the Typical Lot Setbacks detail and dashed setback lines. The minimum required setback for lot lines adjacent to C-2 (west) and O-3 (south) zoning is 10’ or ¾ the height of the adjacent building wall, whichever is greater (UDC Table 6.3-2.A). Based on a wall height of 9’, the Main Residence on Lot 5 requires of minimum setback of 10’ to the south and west lot lines. Based on the Typical Lot Setback detail, the proposed setback is only 6’ to the south and west. To reduce the required setbacks, approval of a Design Development Option (DDO) is required. Submit a DDO as a sub-record to this permit within TDC Online. Instructions on how to create a sub-record, found here: www.tucsonaz.gov/files/sharedassets/public/v/1/pdsd/documents/tdc-faq/new-pdfs/sub-records_071425.pdf. Attach a completed DDO application, found here: www.tucsonaz.gov/files/sharedassets/public/v/1/pdsd/documents/planning-amp-zoning/ddo-for-setback-and-height.pdf. Contact Georgia Pennington at georgia.pennington@tucsonaz.gov for more information about the DDO application process. 2. Previous Comment 4: Currently the proposed lots function as one site due to the potential for shared access and/or parking. Demonstrate how all five lots will function separately and independently of each other; otherwise, this could be considered one multi-family development and potentially be subject to full commercial development standards. **Follow-Up to Previous Comment 4: Zoning acknowledges that Subdivision Assurances will be established to demonstrate that all 5 lots will function independently. Copies of the CC&Rs will be required as part of final plat review. 3. Previous Comment 9: Per the City of Tucson Inclusive Home Design Ordinance, all new dwellings have a requirement to provide an “accessible route from public and common areas, including, but not limited to a driveway or public street or sidewalk”. Draw, dimension, and label an accessible route to each individual unit from the sidewalk or private street to an accessible entrance. **Follow-Up to Previous Comment 9: This comment still stands. An accessible route be provided to each dwelling unit (Main Residence and ADU), from the street/common area to the entrance.
