COMMENTS: Resubmit revised drawings along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also, compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM).

Section 3.3.3.G.5.c UDC, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One-year Expiration date is July 10, 2025.

2-06.4.7 - General Notes

2-06.4.7.A - Zoning and Land Use Notes

4. COMMENT: 2-06.4.7.A.4 – Under Zoning and Land Use note 4 & 5 you list Automotive Minor or Major Service and Repair, excluding bodywork and paint booths, subject to use specific standards 4.9.4.F.2, .3, .4, & .5 and 4.9.13.O. Automotive Major Service and Repair in not an allowed use in the zone therefor this site is considered nonconforming for the use. The use specific standards listed only apply to the Automotive Minor use as a special exception. The existing use should be listed as Automotive Major Service and Repair a nonconforming use with no use specific standards.

5. COMMENT: 2-06.4.7.A.4 – Under the vehicle parking space calculation you list Automotive Storage as a use but it is not listed under Zoning and Land Use note 4 & 5. Is this a use on site. Commercial Storage is not an allowed use in the C-1 Zone.

2-06.4.9 - Information on Proposed Development

7. COMMENT: 2-06.4.9.H.5.a – Until comment 5 is addressed Zoning cannot verify vehicle parking requirements.

8. COMMENT: 2-06.4.9.H.5.d – Provide a bicycle parking calculation on the plan. At a minimum Per UDC Table 7.4.8-1 Retail Trade Use Group 2 short-term and 2 long-term bicycle parking spaces are required for the kiosk (UDC Article 7.4.3.E.1). If you propose to use existing on site bike parking demonstrate that the requirements of UDC Article 7.4.9 are met.

9. COMMENT: 2-06.4.9.O – The street setbacks listed under Development Package Calculation note 4 and under Development Plan Keynote 17 for 21st Street and Gollob Road are not correct. Review UDC Article 6.4.5.C.2.b and show the correct setback.

10. COMMENT: 2-06.4.9.O – Per UDC Article 6.4.5.C.2.b the required street perimeter yard setback from the proposed kiosk to the Gollob Rd. property line is 20’-0”, proposed setback is 10’-0”. A Design Development Option (DDO) must be submitted and approved to reduce the required setback.
