09/07/2023 Real Estate REQUIRES RESUBMIT The development package proposes the use of property currently owned by the City of Tucson, which is planned for the approved El Paso and Southwestern Greenway. Although the applicant has been in discussions with the City about purchasing a portion of this parcel, the area is limited to the west 30 - 35 feet of that parcel, which is approximately 20 feet west of the historic track. There is no purchase agreement in place, and the sale will be subject to Mayor and Council approval. Additionally, the purchase agreement will contain the following development conditions:

1. The applicant must relocate the existing Tucson Water line at their sole expense and to a location approved by Tucson Water and the Department of Transportation and Mobility Greenway Project Team.
2. The applicant must coordinate with the Department of Transportation and Mobility and the Greenway Project Team to ensure the compatibility of their project with the City's future greenway.
3. The applicant must implement the following into their new development:
• Establish a path connection from the new store to the greenway path (built to the property line; The City will add to the greenway design).
• Ensure the landscaping on the new site is consistent with the greenway landscape plan in terms of plant types and density, particularly on the land to be acquired (the City will provide the landscape plan).
• Install a drinking fountain on the new site that is available to the public.
• Refrain from constructing a wall on the east side of the new site to increase visibility and personal safety for path users.

The development package should be revised and resubmitted to reflect the comments above.
09/08/2023 ROW Engineering Review REQUIRES RESUBMIT TD-DEV-0723-00337 (2 N FREEWAY TUCSON, AZ 85745)

Please resubmit revised drawings along with a detailed response letter which states how all comments were addressed.

Comments:

1. TSM 10-01.4.1 Sidewalks in the ROW must comply with the Standard Details for Public Improvement. P. A. G. SD 207 requires a detectable warning surface embedded in access ramps. Please bring the ramps at the southwest corner of the property and southeast corner of the adjacent City owned property up to code.
2. TSM 10-01.3.3 - Sidewalks are required along the entire street frontage of all streets. A sidewalk is required in along the edge of the frontage road.
3. TSM 10-01.3.3 – If there is insufficient ROW for a sidewalk along the frontage road, a pedestrian easement will be required. You can contact Ryan Tripp, Ryan.Tripp@tucsonaz.gov, to obtain a template for the easement.
4. TSM 7-01.3.3 - The onsite circulation path must connect to the sidewalk in both adjacent streets.
5. SDG 3-14 - Where sidewalks cross driveways, the sidewalk should be dominant, maintaining the level, slope, and material of the sidewalk.
6. SDG 3-15 - When the sidewalk is at the back of the curb (as is the case along W Congress St), the sidewalk should be routed behind the driveway apron where driveway crosses the sidewalk. If it is infeasible to route the sidewalk behind the driveway apron, the sidewalk may be lowered to meet at the level of the driveway in order to avoid excessive cross slope. The sidewalk should only be lowered after all other options have been explored. See Tucson Street Design Guide page 77 for visual examples.
7. P. A. G. SD 206, SDG 3-15 Concrete sidewalks that are crossed by driveways should be at least 6” thick.
8. Sidewalk in front of City of Tucson owned property to the east (proposed to be purchased) will need to be repaired where gaps exist.
9. Trails Notes #25 on page 1/19 is incorrect. The planed El Paso & Southwestern Greenway will pass by this location. Please provide a pedestrian connection to the future path from the frontage road sidewalk.
10. Because this development is projected to create 100 new peak hour trips and is in the Major Impact Traffic Zone (MITZ), please include a Transportation Impact Analysis in the next submittal. (ITE Trip Generation: Existing: 6 fueling positions, 3200 SF, estimated 96 AM peak hour trips. Proposed: 8 fueling positions, 5000SF, estimated 216 AM peak hour trips)
11. For Curb Access Ramps, please use P. A. G. SD 207, or a modified version, and include the ramp type in the call out. (page 6, note 21; page, 10 detail I)
12. TAMG Figure 5-12 - Driveway throat length >60’ to parking. Proposed parking on the southeast part of the development appears to not meet this requirement. Please dimension this distance on the site plan.

COMMENTS: Please resubmit revised drawings and any redlined plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

This plan has been reviewed for compliance with the Unified Development Code (UDC), Administrative Manual (AM) Section 2-06, and the Technical Standards Manual (TSM).

Per UDC Section 3.3.3.G.5.c, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year expiration date is August 4, 2024.

1. COMMENT: 2-06.4.3 – Add the development package case number, TD-DEV-0723-00337, adjacent to the title block on all sheets.

2. COMMENT: 2-06.4.7.A.6.a – As the site is located within the Rio Nuevo Area (RNA) and Downtown Zone, Design Review Board (DRB) review and approval are required to zoning approval of TD-DEV-0723-00337. The requirements of UDC 5.12.7 apply to the site.

3. COMMENT: 2-06.4.8.B – The existing ten-foot-wide ingress/egress easement conflicts with the proposed building location. Provide the abandonment information of this easement if it is proposed for vacation, or reconfigure the location of the proposed building to assure no conflicts will occur.

4. COMMENT: 2-06.4.8.C – Provide the recordation information for the adjacent rights-of-way.

5. COMMENT: 2-06.4.9.H.5 – Ensure that a setback of at least one foot is provided between the proposed fuel canopy and the adjacent PAAL and access lanes (UDC 7.4.6.F.2.a.(1)).

6. COMMENT: 2-06.4.9.H.5.a – Clarify why there is a width discrepancy between Details K and O for the proposed handicapped accessible parking spaces.

7. COMMENT: 2-06.4.9.H.5.d – Clarify why the cover sheet indicates two short-term bicycle parking spaces are provided while the site plan shows at least six short-term spaces (four near the north façade and at least two near the south façade).

8. COMMENT: 2-06.4.9.L – As a lot consolidation is proposed for this redevelopment, provide the lot consolidation request submitted to the Pima County Assessor’s Office. A hold will be placed on the Certificate of Occupancy until an approved lot consolidation request has been submitted.

9. COMMENT: 2-06.4.9.R – Ensure that the pedestrian circulation path maintains a minimum width of four feet between the PAAL and patio tables denoted as Keynote 31.

10. COMMENT: 2-07.4.9.S – A pedestrian circulation path is required along the frontage road. A Technical Standards Modification Request (TSMR) is required to be submitted and approved if a pedestrian circulation path abutting the frontage road will not be proposed as depicted.

11. COMMENT: Any buildings or structures proposed for demolition require a separate permit. The demolition permit shall be applied for through the Tucson Development Center Online under application type “Commercial Demolition Permit.”
