Although the applicant has been in discussions with the City on purchasing a portion of this parcel, the area is limited to the west 30 - 35 feet of that parcel, which is approximately 20 feet west of the historic track. There is no purchase agreement in place, and the sale will be subject to Mayor and Council approval. Additionally, the purchase agreement will contain development conditions that require: 1. The applicant is to relocate the existing Tucson Water line, at the applicant's sole expense and in a location approved by Tucson Water. 2. Coordination with the Department of Transportation and Mobility and Greenway Project Team on the compatibility of the applicant's project and the City's future greenway. 3. Implement the following into the applicant's new development: - Path connection from the new store to the greenway path (build to property line; COT will add to greenway design) - Landscaping on the applicant's new site to be consistent with the greenway landscape plan, in both types of plants and density, particularly on the land to be acquired (City will provide landscape plan) - Drinking fountain (on the applicant's new site and available to the public) - No wall on the east side of the applicant's new site (to increase visibility and personal safety for path users) |

| 12/09/2024 | Site Zoning | REQUIRES RESUBMIT | PDSD TRANSMITTAL FROM: PDSD Zoning Review PROJECT: Raze and rebuild of existing Circle K Development Package (1st Review) TD-DEV-0723-00337 TRANSMITTAL DATE: December 9, 2024 DUE DATE: November 27, 2024 COMMENTS: Please resubmit revised drawings and any redlined plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed. This plan has been reviewed for compliance with the Unified Development Code (UDC), Administrative Manual (AM) Section 2-06, and the Technical Standards Manual (TSM). Per UDC Section 3.3.3.G.5.c, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year expiration date is August 4, 2024. 1. This comment was not fully addressed. Zoning was not able to find a building permit to attach a hold for the abandonment of the easement. Provide the permit number with the next submittal. COMMENT: 2-06.4.8.B – The existing ten-foot-wide ingress/egress easement conflicts with the proposed building location. Provide the abandonment information of this easement if it is proposed for vacation, or reconfigure the location of the proposed building to assure no conflicts will occur. 2. This comment was not fully addressed. Zoning was not able to find a building permit to attach a hold for the lot combination to. Provide the permit number with the next submittal. COMMENT: 2-06.4.9.L – As a lot consolidation is proposed for this redevelopment, provide the lot consolidation request submitted to the Pima County Assessor’s Office. A hold will be placed on the Certificate of Occupancy until an approved lot consolidation request has been submitted.
