COMMENTS: Please resubmit revised drawings and any redlined plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is June 25, 2026.


1. COMMENT: Per DP12-0095, the total building area is 67,944 sf. Ensure building dimensions are correct. Include modular classrooms in building area calculations. 2. COMMENT: 2-06.4.7.A.8.c – This comment still stands. As the storage units constitute an expansion of gross floor area provide a building area expansion calculation on the plan. As building area expansions are cumulatively, UDC Article 7.4.3.E, review DP12-0095 and provide a cumulative building expansion calculation.

3. COMMENT: 2-06.4.9.O – Provide perimeter yard setbacks from the storage containers to the east property line. Follow-up comments:
a. The zoning classification along the southeast portion of the parcel is O-3, not C-3. Correct on site plan.
b. Provide the height of the shipping containers.
c. Per UDC Table 6.3-4.A, the minimum required setback in the C-1 zone when adjacent to a residential zone is 1 ½ (H) of the adjacent structure wall. The proposed setback of 6’ does not meet the minimum and will require approval of a Design Development Option (DDO). Please submit a DDO application under the Zoning Modification sub-record that has been created.
