To whom this may concern,
Thank you for the opportunity to comment on TD-DEV-0623-00273, the development plan for a
50' x 40' x 15' eave height prefabricated steel building addition to existing building at 5318 S
Nogales Highway. This development is located in the N.W. quarter of the S.E. quarter of Section
1, Township 15S, Range 13E, of the Gila and Salt River Meridian. The development site
occupies parcel number 137-04-0540 and 137-04-0550, covers approximately 0.483 ± acres,
and is zoned as Commercial Zone 2 (C-2). The nearest major roadway intersection is East
Nebraska Street and South Nogales Highway, approximately 250 feet to the north of the subject
development.
This site does lie within the Tucson International Airport avigation easement requirements and
public disclosure area, FAA traffic pattern airspace, and FAA Part 77 airspace.
The Tucson Airport is requiring a resubmit of this project. These conditions must be included in
the development plan document and shall be identified in the general notes section of all future
plans submitted to the City of Tucson for review.
Conditions of approval:
1. “According to the Federal Aviation Administration (FAA) Notice Criteria Tool, no Notice
Criteria are exceeded. Applicants are therefore not required to file FAA Form 7460.
However, if the use of cranes is anticipated during development and construction
activities, the applicant must file FAA Form 7460 at least 45 days in advance of such
use, to provide the applicant with sufficient time to respond to any concerns identified by
the FAA. Please file Form 7460 at https://oeaaa.faa.gov/oeaaa/external/portal.jsp.”
Although this project does not propose a change in plan designation or zoning the Tucson
Airport Authority highly recommends the applicant add the following notes into the general notes
of the revised development plan. This project is located approximately 1 ½ miles north of
Tucson International Airport and is within FAA traffic pattern airspace, an area which would be
subject to aircraft overflight and noise due to being in close proximity to Tucson International
Airport.
The proposed notes would provide a means of assuring that future owners and tenants of the
property are aware they are in proximity an airport and further assures the continued right of the
City of Tucson, Tucson Airport Authority, and all persons lawfully utilizing the Tucson
International Airport the right to utilize the airspace above or near the property. This would be
accomplished through the property owner recording the Avigation Easement and providing the
Airport Disclosure Statement to the new residents of all residential uses. The Tucson Airport
Authority believes the proposed note helps to support the City of Tucson Airport Environs
Overlay Zone and supports Plan Tucson – Regional and Global Positioning policy 4 (RG-4).
1. "That prior to the City's approval of the proposed development, the property owner must
record the Avigation Easement that discloses the existence and operational
characteristics of the Tucson International Airport to future owners or tenants of the
property and further conveys the right to the public to lawfully use the airspace above the
property. The Avigation Easement shall be recorded in a manner with the Pima County
recorder which shall document it as having title liability. The content of such documents
shall be according to the form and instructions provided.”
The current property owner or person authorized to sign on behalf of the current property
owner must complete, sign, and record the Avigation Easement. Please record the
Avigation Easement with the Pima County Recorder’s Office. Then send a complete
copy of the recorded easement document to Tucson Airport Authority by either email

2. Applicable to residential uses only
“The property owner/developer/applicant must provide the Airport Disclosure Statement
form, at time of sale, to the new property owners with all new unit purchases. In the
event the development of any residential uses does not involve the sale of new units but
is instead offering rental residential units to the public, the new tenant of the rental unit
must be provided a copy of the Airport Disclosure Statement form. The intent of the
Airport Disclosure Statement form is to educate and notify the new residents that they
are living near an airport. The content of such documents shall be according to the form
and instructions provided.”
The property owner (for itself or its tenants) shall forward a signed copy of the Airport
Disclosure Statement form to the Tucson Airport Authority within ten (10) days of
signature, using the Scott Robidoux mailing address provided above.

08/04/2023 Fire New Construction REQUIRES RESUBMIT -Include type of construction to determine fire flow based on IFC appendix B, Table B105.1(2). It is possible you will need to provide 2-3 fire hydrants within the required distance of 400' per IFC 507.5.1. Identify all your hydrants on the site plan with measurements, as the hose lays, to the furthest portion of the building.
-Include what will be stored in the warehouse. It appears it may be used for tire storage. If used for bulk storage of tires, include the cubic feet of tire storage. You may have to install fire sprinklers per IFC 903.2.9.2 if storage exceeds 20,000 cubic feet. This will required a fire service underground to be shown on the DP utility page.

As the building gross floor area expansion is greater than 25% the requirements of UDC Articles 7.4, 7.6 & TSM Sections 7 and 8 apply to the entire site.
1. Provide waste stream calculations compliant with TSM 8-01.8. Show the location of the proposed solid waste enclosure.
2. See Zoning comment 14. A lot combination will be required for the proposed building crossing parcel boundaries. If the project functions as a single site with the neighboring two parcels, waste stream calculations for all buildings on the site will be required in order to determine if adequate solid waste capacity is being provided.
3. Pedestrian circulation is required out to the sidewalk along Nogales Highway.
4. Maximize water harvesting to all landscaped areas through the use of curb cuts and flush curbs.
5. TSM 7.4.6 I.1.d requires that alternative paving in vehicle use areas (gravel pavement) is approved by City engineering staff. Please contact Stephen Blood at Stephen.blood@tucsonaz.gov for surfacing approval.
6. Expansions over 2,000 square feet require first flush retention for the new impervious areas per the Stormwater Detention and Retention manual Section 2.1.2b. Please specify whether the existing surfacing surrounding the warehouse is asphalt or unpaved dirt.
7. The scale of the existing structure does not match aerial photos. The plans show that the proposed warehouse expansion is 50 feet long and will have roughly 45 feet of distance from the expansion to the edge of the parcel. Measurements of the aerial photos of the existing warehouse show that it is roughly 70 feet away from the edge of the parcel at most.

COMMENTS: Please resubmit revised drawings along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also, compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM).

Section 3.3.3.G.5.c UDC, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One-year Expiration date is August 1, 2024.

2-06.3.0 FORMAT REQUIREMENTS

1. COMMENT: 2-06.3.12 – An index of sheets in the development package shall be provided on the first sheet.

2. COMMENT: 2-06.4.1 – Provide an email address for the Designer & Owner listed on the plan.

3. COMMENT: 2-06.4.2.D – The title block shall include the page number and the total number of pages in the package (i.e., sheet xx of xx).

4. COMMENT: 2-06.4.3 – Provide the development package case number, TD-DEV-0623-00273, adjacent to the title block on all sheets.

5. COMMENT: 2-06.4.4 - The project-location map to be located on the first sheet of the development package in the upper right corner, shall cover approximately one square mile, be drawn at a minimum scale of three inch equals one mile, and provide the following information.

6. COMMENT: 2-06.4.4.C – Provide the Section, township, and range label the section corners; and scale on the location map.

2-06.4.7 - General Notes
The following general notes are required. Additional notes specific to each plan are required where applicable.

2-06.4.7.A - Zoning and Land Use Notes

7. COMMENT: 2-06.4.7.A.2 - List the gross area of the site by square footage and acreage.

8. COMMENT: 2-06.4.7.A.4 – It is not clear what the proposed use is. Under Area Calculations/Property Date you list the use as “FOOD SERVICE”, under the Parking Calculation you list “COMMERCIAL ASSEMBLY” and the labels within the foot print of the building show “WAREHHOUSE. Also clarify if this food service warehouse is used for the Tire Shop to the south than all four (4) parcels shall be shown on the plan. Once the use is clarified list all applicable Use Specific Standards found in UDC TABLE 4.8-4: PERMITTED USES - COMMERCIAL AND MIXED USE ZONES.

9. COMMENT: 2-06.4.7.A.6.a - As Nogales Hy. is designated as an Arterial on the COT MS&R Map provide a general note on the cover sheet stating “THIS PROJECT IS DESIGNED TO MEET THE OVERLAY ZONE(S) CRITERIA, UDC ARTICLE 5.4 MAJOR STREETS AND ROUTES SETBACK ZONE (MS&R)

2-06.4.7.A.8 - For development package documents provide:

10. COMMENT: 2-06.4.7.A.8.b – Remove all references to lot coverage as it is not applicable in the C-2 Zone, see UDC Table 6.3-4.

11. COMMENT: 2-06.4.7.A.8.c – Provide a building area expansion calculation on the plan and if applicable a vehicle use area expansion calculation.

12. COMMENT: 2-06.4.7.A.8.d - When the proposed site is part of a larger site, the calculations encompass the entire site, whether existing or proposed. If the project is being phased, calculations must show that, at each phase, requirements are being met. Clarify if this food service warehouse is part of the tire shop to the south or if the food service warehouse is a stand alone site.

2-06.4.8 - Existing Site Conditions
The following information shall be provided on the plan/plat drawing to indicate the existing conditions on site and within 50 feet of the site. On sites bounded by a street with a width of 50 feet or greater, the existing conditions across the street will be provided.

13. COMMENT: 2-06.4.8.C – Provide the following information for Nogales Hv. dimensioned width of paving, curbs, curb cuts, and sidewalks.

2-06.4.9 - Information on Proposed Development
The following information on the proposed project shall be shown on the drawing or added as notes.

14. COMMENT: 2-06.4.9.E – As this site is made up of several parcels, 2 or 4 depending on how comment 13 is addressed, a lot combination is required. Provide a copy of the approved Pima County Assessors Combo request from with the next submittal.

15. COMMENT: 2-06.4.9.F - All existing zoning classifications on and adjacent to the project (including across any adjacent right-of-way) shall be indicated on the drawing with zoning boundaries clearly defined.

16. COMMENT: 2-06.4.9.H.5 & 2-06.4.9.H.5.a – As it appears that the building expansion exceeds 25% per UDC Article 7.4.3.E.1 the requirements of UDC Article 7.4 apply to the entire site. Per UDC Article 7.4.6.K a street or alley cannot be used for maneuvering directly into or from any parking space located wholly or partially outside the public right-of-way. That said the vehicle use area and vehicle parking located within the right-of-way along Nogales may not count toward required or provided requirements.

17. COMMENT: 2-06.4.9.H.5.a – Until comment 9 & 13 are addressed vehicle parking requirements cannot be determined.

18. COMMENT: 2-06.4.9.H.5.a – The vehicle parking spaces calculation shall include the number of required and provided accessible parking spaces to include van accessible spaces.

19. COMMENT: 2-06.4.9.H.5.a – Until comment 9 & 13 are addressed electrical vehicle supply requirements cannot be determined, UDC Article 7.4.11..

20. COMMENT: 2-06.4.9.H.5.c - Until comment 9 & 13 are addressed loading space requirements cannot be determined.

21. COMMENT: 2-06.4.9.H.5.d - Until comment 9 & 13 are addressed bicycle parking requirements cannot be determined. As most uses requirement short- & long-term bicycle parking clearly show the location on the plan and provide a detail that clearly demonstrates that the requirements of UDC article 7.4.9 are met.

22. COMMENT: 2-06.4.9.O – The street perimeter yard setback listed is not correct. Review UDC Article 6.4.5.C.2 and provide the correct street perimeter yard setbacks.

23. COMMENT: 2-06.4.9.O – The Rear setback listed is not correct. Review UDC TABLE 6.3-4.A: DIMENSIONAL STANDARDS FOR THE C-1, C-2, C-3, OCR-1, & OCR-2 ZONES, C-2 Zone and provide the correct perimeter yard setback.

24. COMMENT: 2-06.4.9.O – Provide a setback dimension for the corner of the proposed expansion to the west property line.

25. COMMENT: 2-06.4.9.Q – Provide the height of the existing and proposed building within the footprint.

26. COMMENT: 2-06.4.9.Q – The Building Ht. Maximum 50’-0” listed is not correct. Review UDC TABLE 6.3-4.A: DIMENSIONAL STANDARDS FOR THE C-1, C-2, C-3, OCR-1, & OCR-2 ZONES, C-2 Zone and provide the correct allowed height.

27. COMMENT: 2-06.4.9.R – As it appears that the building expansion exceeds 25% per TSM Section 7-01.2.B.2 the requirements of TSM Section 7 apply to the existing use or structure, as well as the expansion. Clearly demonstrate that all requirements of TSM Section 7 are met.

28. COMMENT: 2-06.4.9.T – Clearly show the refuse collection areas, including locations of dumpsters, screening location and materials, and vehicle maneuverability, fully dimensioned, and access route.

29. COMMENT: 2-06.4.9.W - Indicate the locations and types of proposed signs (wall, free-standing, pedestal) to assure there are no conflicts with other requirements and that minimal locational requirements can be met. Also provide a general note stating all signs require separate permits.

2. A parking lot within the Right-of-way will only be considered if included as part of the landscape plan. A landscape plan within the ROW must have prior approval from DTM. Please submit a request for approval of a landscape plan within the ROW, from DTM.
3. If the landscape plan in the ROW with a parking lot is approved by DTM, an application for a Temporary Revocable Easement (TRE) with the City’s Real Estate Division is required. If the TRE is approved, an annual fee will be charged.
4. Throat depth from edge of the roadway (Nogales Hwy) to the edge of the parking lot shall be 60’.
5. Any existing curb or sidewalk that is noncompliant with current standards will be modified or replaced to meet current standards.
