COMMENT: Resubmit revised drawings along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also, compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM).

Per UDC Article 3.3.3.G.5.c, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One-year Expiration date is July 8, 2026.

2-06.4.0 CONTENT REQUIREMENTS

2-06.4.9 - Information on Proposed Development
The following information on the proposed project shall be shown on the drawing or added as notes.

3. COMMENT: 2-06.4.9.H.5.a – The required number of vehicle parking spaces, 13 is not correct. Per UDC Article 7.4.3.G When the calculation of required motor vehicle spaces results in a fractional number, a fraction of less than one-half is adjusted to the next lower whole number or 12 required.

4. COMMENT: 2-06.4.9.H.5.d – The provided short-term bicycle parking does not address UDC Articles 7.4.9.B.1.e, 7.4.9.B.2.f, & .g

5. This comment was not addressed correctly. The required perimeter yard setback for the north property line, Speedway Blvd. Arterial, should be shown as 10’-0”, UDC Article 6.4.5.C.2.a, and the setback to the east property line, Bentley Ave., Local, should be 20’-0”. UDC Article 6.4.5.C.2.b. COMMENT: 2-06.4.9.O – The 10’ required side street perimeter yard setback shown under General Note 15 is not correct. Review UDC Article 6.4.5.C.2.b and provide the correct required side street perimeter yard setback.

6. COMMENT: 2-06.4.9.O – Per UDC Table 6.3-4.A C-1 Zone, Nonres Use to a Res Zone the minimum required perimeter yard setback is 1 ½ (H) = Height of the proposed exterior building wall. Based on the 20’-8 ½” the required perimeter yard setback from the proposed building to the south property line is 31’-1”, proposed perimeter yard setback is 18’-6”. A Design Development Option (DDO) must be submitted and approved to reduce the required setback. 7. COMMENT: 2-06.4.9.R – Provide a sidewalk width dimension for the sidewalk that runs along the west side of the proposed patio and for the sidewalk that runs along the northeast corner of the patio.
