Thank you for the opportunity to comment on TD-DEV-0523-00245, the development plan for a
commercial Tire-Mart shop at 5570 East Travel Plaza Way and it occupies 8.41 acres ±. This
parcel is located northeast of the intersection of S. Craycroft Road and Interstate 10,
immediately north of the northern frontage road on Interstate 10. This parcel is located within
the NW ¼ of the SW ¼ of Section 13, Township 15S, Range 14E, of the Gila and Salt River
Meridian.
This parcel lies within the Tucson International Airport avigation easement requirements and
public disclosure area, FAA traffic pattern airspace, FAA Part 77 airspace.
The Tucson Airport Authority provided the below conditions associated with rezoning submittal
TP-ENT-0523-00021, which is also occurring on the underlying parcel where this proposed
project is occurring. The Tucson Airport Authority is requiring a resubmittal to include these
below notes in the general notes section of all future plans submitted to the City of Tucson for
review.
Conditions of approval:
1. “According to the Federal Aviation Administration (FAA) Notice Criteria Tool, this project
area is located in proximity to a navigation facility and could impact navigation signal
reception. As this project develops, all applicants must file FAA Form 7460 with the FAA
at least 45 days before construction activities begin unless FAA staff, with the
Obstruction Evaluation / Airport Airspace Analysis (OE/AAA), provides the project
applicant with written communication that filing FAA Form 7460 is not required. It is
highly recommended that the applicant file earlier than 45 days to provide the applicant
with sufficient time to respond to any concerns identified by the FAA. Note also that
cranes to be used during all development or construction activities must also be
identified with Form 7460. Please file Form 7460 at
https://oeaaa.faa.gov/oeaaa/external/portal.jsp.”
2. “An Avigation Easement must be executed and recorded with the Pima County
Recorder’s Office, by the property owner/developer/applicant or other person authorized
to sign on behalf of the current property owner, to cover the entire project area and in
accordance with the requirement of the Tucson Airport Authority. The Avigation
Easement must run with the property and will serve to educate future purchasers and
tenants of the property of potential aviation impacts.”

a. The property owner/developer/applicant must provide the Airport Disclosure
Statement form, at time of sale, to the new property owners with all new unit
purchases. In the event the development of any residential uses does not involve
the sale of new units but is instead offering rental residential units to the public,
the new tenant of the rental unit must be provided a copy of the Airport
Disclosure Statement form. The intent of the Airport Disclosure Statement form is
to educate and notify the new residents that they are living near an airport. The
content of such documents shall be according to the form and instructions
provided.
The property owner (for itself or its tenants) must forward a signed copy of the
Airport Disclosure Statement form to the Tucson Airport Authority within ten (10)

As the building gross floor area expansion is greater than 25% the requirements of UDC Articles 7.4, 7.6 & TSM Section 7 apply to the entire site.
1. Provide pedestrian circulation paths from the proposed building to the rest of the site as well as out to the sidewalk along E Travel Plaza Way per TSM 7-01.3.3.
2. Provide dimensions for proposed sidewalks on either side of the expansion. Sidewalks must have an unobstructed width of at least 4 feet. If there are no wheel stops provided in each parking space, the sidewalk must be an additional 2.5 feet wide to accommodate vehicle encroachment (TSM7-01.4.3 A).
3. Show that the sidewalks on either side of the expansion are separated from the travel lane by 6 inch curbs or railings compliant with TSM7-01.4.2 A.

COMMENTS: Please resubmit revised drawings along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also, compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM).

Section 3.3.3.G.5.c UDC, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One-year Expiration date is May 16, 2024.

8. COMMENT: 2-06.4.7.A.8.d - When the proposed site is part of a larger site, the calculations encompass the entire site, whether existing or proposed.

2-06.4.9 - Information on Proposed Development
The following information on the proposed project shall be shown on the drawing or added as notes.

9. COMMENT: 2-06.4.9.H.5 – Clearly show the entire vehicle use area, existing & proposed, on the plan, fully dimensioned.

10. COMMENT: 2-06.4.9.H.5.a – Until comment 8 is addressed and all required & provided vehicle parking spaces are shown on the plan, fully dimensioned Zoning cannot review for compliance.

11. COMMENT: 2-06.4.9.H.5.a – It’s not clear but it appears that you are proposing vehicle parking spaces in front of maintenance bays. If this is the case the spaces shown in front of the bays may not count toward the required number of vehicle parking spaces.

12. COMMENT: 2-06.4.9.H.5.a – Provide a detail for both standard and accessible vehicle parking spaces.

13. COMMENT: 2-06.4.9.H.5.a – Clearly demonstrate that the requirements of UDC Article 7.4.11 & 7.4.12 are met.

14. COMMENT: 2-06.4.9.H.5.d – Clearly show all bicycle parking, existing & proposed on the plan and clearly demonstrate that that the existing and proposed meet the requirements of UDC Article 7.4.9.

15. COMMENT: 2-06.4.9.O - The street perimeter yard setbacks listed are not correct. Review the recent amendments to the UDC found at: https://www.tucsonaz.gov/pdsd/development-code-update, and provide the correct setbacks.

16. COMMENT: 2-06.4.9.Q – The Maximum Permitted height listed on the plan is not correct. Review UDC Table 6.3-4.A and provide the correct allowed height.

17. COMMENT: 2-06.4.9.R – Clearly demonstrate that the requirements of TSM Section 7 are met for the entire site.

18. COMMENT: 2-06.4.9.U - Indicate graphically, where possible, compliance with conditions of rezoning.

19. COMMENT: 2-06.4.9.W - Indicate the locations and types of proposed signs (wall, free-standing, pedestal) to assure there are no conflicts with other requirements and that minimal locational requirements can be met. Also provide a general note stating all signs require separate permits.
