02/09/2024 | Site Zoning | REQUIRES RESUBMIT | PDSD TRANSMITTAL FROM: PDSD Zoning Review PROJECT: Saia Motor Freight Line, LLC - Tucson Development Package (3rd Review) TD-DEV-0523-00230 TRANSMITTAL DATE: February 09, 2024 DUE DATE: February 10, 2024 COMMENTS: Please resubmit revised drawings along with a detailed response letter, which states how all Zoning Review Section comments were addressed. This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also, compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM). Section 3.3.3.G.5.c UDC, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One-year Expiration date is January 11, 2025. 1. COMMENT: 2-06.4.8.B – The “PROPOSED OFFICE/DOCKS” building appears to be sitting on top of several easements. Zoning acknowledges the applicant is proposing to abandon the existing easements on site through separate submittal and recordation of a Fina Plat. Per Technical Standards Manual (TSM) Section 11-01-.4.0, “The interest of the City of Tucson is abandoned by recordation of the final plat. However, the interests of other entities may also have to be abandoned prior to recording the final plat.” The existing easements will have to be abandoned with a recordable document such as a quit-claim deed or abandonment of easement which relinquishes its interest in the easement (TSM Section 11-01.4.0). If the applicant can provide copies of a recordable document such as a quit-claim deed or abandonment of easement, on the next submittal, for the easements shown on the provided Title Report, a separate Final Plat submittal will not be required. This Development Package cannot be approved until the existing easements are abandoned per the above standard.
