05/10/2023 | Site Zoning | REQUIRES RESUBMIT | PDSD TRANSMITTAL FROM: PDSD Zoning Review PROJECT: Stine – Hawaiian Bros – Str: 59 Development Package (1st Review) TD-DIV-0423-00212 TRANSMITTAL DATE: May 10, 2023 DUE DATE: May 21, 2023 COMMENTS: Please resubmit revised drawings along with a detailed response letter, which states how all Zoning Review Section comments were addressed. This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also, compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM). Section 3.3.3.G.5.c UDC, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One-year Expiration date is April 20, 2024. 2-06.3.0 FORMAT REQUIREMENTS 1. COMMENT: 2-06.3.7 - A small, project-location map shall be provided in the upper right corner of the cover sheet. CONTENT REQUIREMENTS 2. COMMENT: 2-06.4.2.B – Provide a brief legal description within the title block. 3. COMMENT: 2-06.4.2.D – Provide the page number and the total number of pages in the package (i.e., sheet xx of xx), within the title block. 4. COMMENT: 2-06.4.3 – Provide the development package case number, TD-DIV-0423-00212, adjacent to the title block on all sheets. 5. COMMENT: 2-06.4.4 - The project-location map to be located on the first sheet of the development package in the upper right corner, shall cover approximately one square mile, be drawn at a minimum scale of three inch equals one mile 6. COMMENT: 2-06.4.4.C – Provide the section, township, and range; label the section corners, and provide a north arrow, and the scale on the location map. 2-06.4.7 - General Notes The following general notes are required. Additional notes specific to each plan are required where applicable. 2-06.4.7.A - Zoning and Land Use Notes 7. COMMENT: 2-06.4.7.A.4 – Review UDC Table 4.8-4 and identify the existing and proposed use of the property as classified per the UDC. List all UDC sections applicable to the proposed uses. “QUICK SERVE RESTAURANT W/ DRIVE-THRU” is not a use classified in the UDC> 8. COMMENT: 2-06.4.7.A.6.a - As Wilmot Rd. is designated as an Arterial on the COT MS&R Map provide a general note on the cover sheet stating “THIS PROJECT IS DESIGNED TO MEET THE OVERLAY ZONE(S) CRITERIA, UDC ARTICLE 5.4 MAJOR STREETS AND ROUTES SETBACK ZONE (MS&R) 2-06.4.8 - Existing Site Conditions The following information shall be provided on the plan/plat drawing to indicate the existing conditions on site and within 50 feet of the site. On sites bounded by a street with a width of 50 feet or greater, the existing conditions across the street will be provided. 9. COMMENT: 2-06.4.8.C – Dimension the width of paving, curbs, curb cuts, and sidewalks along Wilmot Rd. 2-06.4.9 - Information on Proposed Development The following information on the proposed project shall be shown on the drawing or added as notes. 10. COMMENT: 2-06.4.9.F - All existing zoning classifications on and adjacent to the project (including across any adjacent right-of-way) shall be indicated on the drawing with zoning boundaries clearly defined. 11. COMMENT: 2-06.4.9.H.5 – Clearly demonstrate on the plan how the requirements of UDC Article 7.4.6.F.2.a.(2) are met for the proposed addition to the drive-through. 12. COMMENT: 2-06.4.9.H.5.a – As you are proposing to reduce the required number of vehicle parking spaces some type of reduction is required. Review UDC Article 7.4.5, or 7.4.10 for possible reductions. If you do not will to use the allowed reductions a Board of Adjustment for Variance will be required to reduce the number of provided vehicle parking spaces. 13. COMMENT: 2-06.4.9.H.5.a – Provide a dimension from the north side to the proposed long-term bicycle parking to the vehicle parking space so that the requirements of UDC Article 7.4.6.D.2.b can be verified. 14. COMMENT: 2-06.4.9.H.5.d – Provide a short-term bicycle parking space detail that clearly demonstrates that the requirements of UDC Articles 7.4.9.B.1.e, 7.4.9.B.2.f are met. Also demonstrate how the requirement of UDC Article 7.4.9.D.5 are met. 15. COMMENT: 2-06.4.9.O – Clarify if the perimeter yard setbacks shown are proposed or required. Based on amendments to the UDC adopted April 21, 2023, the street perimeter yard setback to Wilmot is now 10’-0”, https://www.tucsonaz.gov/files/integrated-planning/pdsd/Adopted_UDC_Amendments_redline.pdf. 16. COMMENT: 2-06.4.9.O – As the UDC has not requirement for perimeter yard setbacks to “PAVEMENT” clarify what the pavement setbacks shown on the plan are for. 17. COMMENT: 2-06.4.9.Q – Provide the square footage, height and the specific use proposed within the footprint of the building on sheet 3. 18. COMMENT: 2-06.4.9.W – Provide a general note on the plan stating all signs require separate permits.
