I have reviewed the Development Package for a Flexible Lot Development (TDDEV-
0326-00076) submitted April 2026 for the purpose of determining
conformance with the Design Requirements of the FLD. I have checked the
submittal against the Flexible Lot Development (FLD) Development
Requirements relative to Section 8.7.3., Design Standards under procedure
described in Section M4a.

17. Transition Edge Treatment and Mitigation
for Adjacent Properties

Thank you for the opportunity to comment on TD-DEV-0326-00076, 1st Submittal, a
development plan for a new single family residential development at 2142 E Ganley Rd. This
development is located in the N.W. quarter of the S.W. quarter of Section 8, Township 15S,
Range 14E, of the Gila and Salt River Meridian. The development site occupies parcel number
140-28-015C, covers approximately 4.3 ± acres, and is zoned as Residence 2 Zone (R-2). The
nearest major roadway intersection is South Sears Boulevard and East Ginter Road,
approximately 650 feet to the southwest of the subject development.
This site does lie within the Tucson International Airport avigation easement requirements and
public disclosure area, FAA traffic pattern airspace, FAA Part 77 airspace, City of Tucson
Airport Environs Zone – Airport Hazards Districts, and City of Tucson Airport Environs Zone –
Height Zone 50 – 65 Feet.
Below are the responses that the FAA Notice Criteria Tool provided on the applicant’s project.
1) Based on the information you provided, you are required to file notice with the FAA. You
must submit notice at least 45 days before the start of the proposed construction or
alteration or the date an application for a construction permit is filed, whichever is
earliest.
2) Note: If you propose construction or alteration that is subject to the licensing
requirements of the Federal Communications Commission (FCC), you must submit
notice to the FAA on or before the date that an application is filed with the FCC. Visit
FCC Licensing to learn more.
The Tucson Airport Authority is requiring a resubmittal of this project. The below conditions of
approval must be added as note #5 within the Tucson Airport Authority notes for the
development plan.
Conditions of approval:
1. “The applicant shall file FAA Form 7460 with the FAA at least 45 days before
construction activities begin unless FAA staff, with the Obstruction Evaluation / Airport
Airspace Analysis (OE/AAA), provides the project applicant with written communication

Site Engineering:
1. Provide the development package case number, TD-DEV-0326-00076, adjacent to the title block on all sheets.
2. As the reference Detail L on the Detail Sheet shows proposed wall for site to be 8-feet tall CMU, it will be required that a separate wall building permit be submitted for structural review. All non-retaining walls that exceed 7-feet in height from natural grade fall under the “structural” designation. For the new wall permit, please submit the structural calculations and drawings for the construction of the wall. Revise the keynote for the wall to reflect this: “Wall to be built under separate permit.”

Drainage Comments:
1. All Basins shall have a minimum of 1 sediment level measurement device, which can be incorporated into the weir or the side slope, or constructed as a separate stand-alone device. The device(s) shall be located where sediment is likely to accumulate. DSSDR 4.4.1.4 Provide a keynote/call-out and construction detail relating to the selected sediment level device. These should be shown within Basin 1-4 and the associated channels.
2. Provide inlet’s and outfall’s for each of the basins. DSSDR Sections 4.8 & 4.9
3. Show that erosion protection is used for all inlet and outlet structures on the Grading sheet and details. The erosion protection shall extend below the finished grade of the basin floor and/or side slope to the appropriate design depth. DSSDR 4.8.1.4 Show this for all inlet & outlet structures as it appears erosion protection is not clearly shown. Ensure to extend below finished grade into the basins.
4. Show that the retention/detention basins are the minimum required 10 feet setback from structures, DSSDR 5.3.1.11. If they are to be proposed within that setback, Geotechnical justification must be included in the provided Geotech report to provide recommendations on possible reduced setback requirements. COT Drainage Manual 14.2.6
5. When a wall is proposed within 5 feet of the horizontal location of the 100-year water surface elevation, a report from an engineer registered in the State of Arizona shall be provided prior to approval of the construction permit that contains at least the following: a. The appropriate setback; and b. Specific structural design requirements with details DSSDR 4.14.1.3 This will need to be addressed regarding a majority of the masonry wall shown abutting basins and/or washes.
6. Include spot elevations at curb cut inlets, bottom of basin and curb cut outlets for quick reference during site inspections.
7. Provide proper setback of drainage channels/swales to sidewalks, structures, and lot lines. COT Drainage Manual 7.6.5

Drainage Report Comments:
1. Please revise Figure A-1 Existing Conditions Exhibit Table title to “Existing Condition Watersheds”
2. Please revise Figure A-2 Developed Condition Watersheds Table to include the final post-developed 2-, 10- and 100-year peak discharge rates to 85% of the predeveloped peak discharge rates shown in the body of the report. See DSSDR Section 1.2.
3. Please provide all flow paths for existing and proposed site within Figure A-1 and A-2.
4. Provide an inspection and maintenance protocol including frequency of inspection, a checklist of items to be inspected and recommended maintenance when an inspection identifies a maintenance requirement shall be prepared by an Arizona registrant. The protocol may be included in the project drainage report or prepared as a separate document. The protocol shall be reviewed and approved by the Floodplain Administrator prior to approval of the tentative plat or development plan. The protocol shall be delivered to the entity responsible for inspection and maintenance. An example of a detention basin inspection and maintenance checklist is provided in Appendix F. DSSDR 4.1.1
5. Provide a simple summary table in the conclusion portion of the report to compare the Pre-Development Vs. Post-Development peak discharges for the 2-, 10-, & 100-yr events to clearly show that the development falls within compliance with critical basin detention requirements.

Per UDC Section 3.3.3.G.5.c, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year expiration date is March 26, 2027.

2-06.4 CONTENT REQUIREMENTS

Per UDC Table 6.3-2.A, in R-2 zones, when a residential use abuts a nonresidential zone (as this property does to the east), the minimum setback is 10’ or ¾ the height of the adjacent building, whichever is greater. To the west, where it abuts residential use, the setback is 6’ or 2/3 the height of the adjacent building. To E Ganley Rd and to E Ginter Rd, the setback is 20’.

Applicants requesting a setback reduction must indicate what the required and reduced setbacks are and their locations. Applicants requesting a reduced street setback must provide a written description of how the reduced yard will enhance the architectural design or the vehicular circulation in the FLD and submit a transportation statement, or if required by DTM, a traffic impact study;

5. COMMENT: 2-06.5.3.A – Provide requested information, including what the required internal setback is for R-2, as well as the requested setback, in the calculations table on Sheet 1. Interior street setback is required to be 20’. The typical lot profiles on Sheet 2 indicate as low as 5’. Provide the written description of how the reduced yard will enhance the architectural design or the vehicular circulation in the FLD.

5.3.D Building Elevations. Provide dimensioned building elevations of all proposed units. The elevations can be preliminary drawings. The model home construction plans will be used to determine exact setbacks and screening requirements at the time of application for building permits;

6. COMMENT: 2-06.5.3.D – Provide requested information.

5.3.E Architectural Variation Plan. When applicable, an Architectural Variation Plan (AVP) is required in accordance with UDC Section 8.7.3.M.1 as follows:
1) Identify on the tentative plat or site plan the lots and/or units that must provide architectural variation; and,
2) Provide a written statement and drawings (elevations, building footprints) demonstrating how the proposed architectural variation techniques comply with UDC Section 8.7.3.M.1.
3) Alternative Compliance requests require the following in addition to the Architectural Variation Plan:
4) Rationale for Alternative Compliance with the requirements of Section 8.7.3.M.1;
5) Explanation of how the proposed is best practice; and,
6) Photographs and/or graphical illustrations to support the rationale and best practice.

7. COMMENT: 2-06.5.3.E – An Architectural Variation Plan is required for this proposal. Please provide an AVP as described in UDC 8.7.3.M.1.

5.3.G Covenants, Conditions, and Restrictions
1) Provide a copy of the Covenants, Conditions, and Restrictions (CC&Rs) regarding the homeowner’s association’s responsibility for the ownership and maintenance of commonly-owned property.
2) Provide a copy of the protective covenants or common use agreements for any shared areas being established by easements over individually owned property.

8. COMMENT: 2-06.5.3.G – Provide requested information.
