This plan has been reviewed for compliance with applicable development criteria in the City of Tucson Unified Development Code (UDC) Administrative Manual (AM) Section 2-11 and Technical Manual (TM) Section for landscape, native plants, and water harvesting.

Please resubmit revised drawings along with a detailed response letter, which states how all of the Site Landscape and NPPO Section review comments have been addressed.

SITE LANDSCAPE/NPPO SECTION COMMENTS:

1. Outdoor storage areas require a street landscape border. See UDC 7.6.4 and Table 7.6.4-1 (Outdoor Storage land use adjacent to MS&R and Non-MS&R). Provide an updated landscape plan that includes the required trees and vegetative groundcover within the first 10 feet on site from the existing or future right of way line along E Fair St. The Street landscape border shall include all street frontage to the south of all three parcels sharing the same ownership.

COMMENTS: Please resubmit revised drawings and any redlined plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is March 18, 2026.

2-06.4.7 - General Notes
The following general notes are required. Additional notes specific to each plan are required where applicable.

2-06.3.0 FORMAT REQUIREMENTS 2-06.3.12 - An index of sheets in the development
package shall be provided on the first sheet.

1. COMMENT: 2-06.3.12 – Please include sheet numbers in the index (IE: CS01 – sheet 1,
DT01 – sheet 2). Also, please organize the sheets in order as noted by the standard
above.

This comment was not fully addressed. Reorganize sheets into the correct order per individual page numbers, or relabel sheet numbers.


Zoning and Land Use Notes

2-06.4.7.A.2 - List the gross area of the site/subdivision by square footage and acreage.

2. COMMENT: 2-06.4.7.A.2 – The overall site parcel(s) listed is incorrect. Please include the correct parcel numbers associated with this project (IE: 132-17-133K, 132-17-133J, 132-17-133L, 132-17-133F, and 132-17-133D). Also, please update the existing building GFA with the correct buildings as noted by the standard above.

This comment was not addressed fully. UDC 11.4.20 defines a site as: “The land area consisting of a portion of a lot , an entire lot , or contiguous lots , not including dedicated public property, designated for development as a single entity.” These parcels meet the definition of a site since they share parking, access to the public right-of-way, and in the case of three of the parcels, common ownership under Cuber LLC.

2-06.4.7.A.4 - Identify the existing and proposed use of the property as classified per the UDC. List all UDC sections applicable to the proposed uses.

3. COMMENT: 2-06.4.7.A.4 – Identify the existing uses for the site as noted by the standard above. The proposed use says “Livaway Suite Hotel Facility Subject To Use Specific Standard 4.9.9.B.1”. Please clarify if this is a change of use.

This comment was not addressed. Light Industrial is a description of the I-1 zone, but is not a zoning use per the UDC. See UDC Table 4.8-5 for a list of permitted uses within the I-1 zone here: https://codelibrary.amlegal.com/codes/tucson/latest/tucson_az_udc/0-0-0-2105. Indicate both existing and new proposed uses on site.

The submittal still incorrectly states that the proposed use is “Livaway Suite Hotel…”. Please correct. The proposed new use of outdoor storage should be classified as: “Commercial Storage, subject to use-specific standard 4.9.10.A and 4.9.13.Q”

2-06.4.7.A.6.b - If there is more than one lot within the site, the note should specify which lots are affected by the additional applications or overlay zones.

4. COMMENT: 2-06.4.7.A.6.b – As this site is composed of multiple lots, please show all buildings on the site and list their existing uses.

2-06.4.7.A.8 - For development package documents provide:

This comment was not addressed. No requested information was found on the cover page as indicated in the comment response letter.

2-06.4.7.A.8.c - Percentage of building, lot area, or vehicular use area expansion. If the building(s) or lot area have been previously expanded, those calculations shall be included; and,

6. COMMENT: 2-06.4.7.A.8.c – Please include the information as noted by the standard above (IE: vehicular use expansion).

If no expansion of gross floor area is planned, indicate that no expansion of GFA is proposed. Indicate area of outdoor storage as a percentage of the existing Cuber LLC GFA in a separate general note.

2-06.4.7.A.8.d - When the proposed site is part of a larger site, the calculations encompass the entire site, whether existing or proposed. If the project is being phased, calculations must show that, at each phase, requirements are being met.

7. COMMENT: 2-06.4.7.A.8.d – Please include the information as noted by the standard above as this site includes 4 existing buildings and their associated parking.

2-06.4.9 - Information on Proposed Development
The following information on the proposed project shall be shown on the drawing or added as notes.

2-06.4.9.H.5.a - Show all motor vehicle off-street parking spaces provided, fully dimensioned. As a note, provide calculations on the number of spaces required (include the ratio used) and the number provided, including the number of spaces required and provided for the physically disabled. The drawing should indicate
parking space locations for the physically disabled. A typical parking space detail shall be provided for both standard parking spaces and those for the physically disabled. For information on parking requirements for the physically disabled, refer to adopted building and accessibility codes of the City of Tucson. Design criteria for
parking spaces and access are located in Section 7.4.6, Motor Vehicle Use Area Design Criteria, of the UDC.

8. COMMENT: 2-06.4.9.H.5.a – Typical parking stall on sheet DT01 overlaps the wheelstop detail. Correct the graphic error.

Although the comment response letter refers to cover sheet for required parking, no updated motor vehicle parking calculations table is provided. Provide an updated motor vehicle parking calculation table for the site. See UDC Table 7.4.4-1 for additional parking required for the proposed outdoor commercial storage area. Show required parking on the site map.

2-06.4.9.H.5.d - Show bicycle parking facilities fully dimensioned. For specifics, refer to Section 7.4.9, Bicycle Parking Design Criteria, of the UDC. Provide, as a note, calculations for short and long term bicycle spaces required and provided.

9. COMMENT: 2-06.4.9.H.5.d – Provide bicycle parking requirements as part of the parking calculations table requested in comment 2-06.4.9.H.5.a.
