Thank you for the opportunity to comment on TD-DEV-0323-00179, the development plan for a reconfiguration of existing site to allow for new speculative warehouse and truck court at 1402 W Ajo Way. This development is located in the S.E. corner of the S.E. quarter of Section 36, Township 14S, Range 13E, of the Gila and Salt River Meridian. The development site occupies parcel number 120-09-309B, covers approximately 11.93 ± acres, and is zoned as Light Industrial Zone 1 (I-1). The nearest major roadway intersection is South 3rd Ave and East Irvington Road, approximately 180 feet to the southwest of the subject development.
This site does lie within the Tucson International Airport avigation easement requirements and public disclosure area, FAA traffic pattern airspace, and FAA Part 77 airspace.
The Tucson Airport Authority approves the subject request contingent upon the following conditions of approval, as noted below. These conditions must be included in the development plan document and shall be identified in the general notes section of all future plans submitted to the City of Tucson for review.
Conditions of approval:
1. “According to the Federal Aviation Administration (FAA) Notice Criteria Tool, no Notice Criteria are exceeded. Applicants are therefore not required to file FAA Form 7460. However, if the use of cranes is anticipated during development and construction activities, the applicant must file FAA Form 7460 at least 45 days in advance of such use, to provide the applicant with sufficient time to respond to any concerns identified by the FAA. Please file Form 7460 at https://oeaaa.faa.gov/oeaaa/external/portal.jsp.”
Although this project does not propose a change in plan designation or zoning the Tucson Airport Authority highly recommends the applicant add the following notes into the general notes of the revised development plan. This project is located approximately 2 miles northwest of Tucson International Airport and is within FAA traffic pattern airspace, an area which would be subject to aircraft overflight and noise due to being in close proximity to Tucson International Airport.
The proposed notes would provide a means of assuring that future owners and tenants of the property are aware they are in proximity an airport and further assures the continued right of the City of Tucson, Tucson Airport Authority, and all persons lawfully utilizing the Tucson International Airport the right to utilize the airspace above or near the property. This would be accomplished through the property owner recording the Avigation Easement and providing the Airport Disclosure Statement to the new residents of all residential uses. The Tucson Airport Authority believes the proposed note helps to support the City of Tucson Airport Environs Overlay Zone and supports Plan Tucson – Regional and Global Positioning policy 4 (RG-4).

"That prior to the City's approval of the proposed development, the property owner must record the Avigation Easement that discloses the existence and operational characteristics of the Tucson International Airport to future owners or tenants of the property and further conveys the right to the public to lawfully use the airspace above the property. The Avigation Easement shall be recorded in a manner with the Pima County recorder which shall document it as having title liability. The content of such documents shall be according to the form and instructions provided.”
The current property owner or person authorized to sign on behalf of the current property owner must complete, sign, and record the Avigation Easement. Please record the Avigation Easement with the Pima County Recorder’s Office. 1. Provide a waste stream calculation meeting the requirements of TSM 8-01.8.
2. Provide proposed bottom and top elevations for each detention basin on the grading plans.
3. The drainage report states in section 3.2 that drainage will be conveyed through a series of storm drain pipes to the northwestern corner of the site. Clarify how stormwater will be moving from the basins to the south and the east to the northwestern most detention basin. Show the weir or storm drain that will be regulating the drainage from this basin to 3rd Ave.
4. Include invert elevations for the proposed and existing storm drains.
5. The total values of peak discharge in Table 2 and Table 3 do not match. My understanding is that Table 2 is the proposed unattenuated peak discharge split into 2 watersheds and Table 3 is the proposed unattenuated peak discharge split into 7 watersheds and therefore their total peak discharge values should match.
6. Provide a figure similar to Table 2.2 in the Stormwater Detention-Retention Manual to demonstrate that first flush requirements are being calculated correctly.
7. Show full pedestrian circulation to the proposed dumpster enclosure.
8. Provide spot slopes and cross slopes of proposed sidewalk in the grading plan.
9. Show locations of roof downspouts. Stormwater from roof drains must be contained underneath the sidewalk through use of scuppers per TSM 7-01.4.3D.
10. Specify what the diamond symbol marked GB is on the SWPPP pages.

This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also, compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM).

Section 3.3.3.G.5.c UDC, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One-year Expiration date is May 11, 2024.

2-06.2.0 APPLICATION SUBMITTAL REQUIREMENTS

1. COMMENT: 2-06.2.2 – Clarify why there are two different sheets, AS-100 & C-1.1, with development standard calculations. Eliminate one set of calculations from the plan set to help facilitate plan review. Zoning has only reviewed sheet AS-100 for development standard compliance.

2. COMMENT: 2-06.2.4 – The development package is designed to allow for concurrent review of any site related reviews. Remove all references to building codes and occupancy from the plan.

2-06.3.0 FORMAT REQUIREMENTS

3. COMMENT: 2-06.3.7 – The location map shall be located in the upper right corner of the cover sheet.

4. COMMENT: 2-06.3.12 – An index of sheets, including all sheets submitted, in the development package shall be provided on the first sheet.

CONTENT REQUIREMENTS

5. COMMENT: 2-06.4.2.B – Provide a brief legal description within the title block on all sheets.

6. COMMENT: 2-06.4.2.D – Provide the page number and the total number of pages in the package (i.e., sheet xx of xx) within the title block on all sheets. Total number shall include all sheets submitted in the package.

Warehouse is not a use classified in the UDC. Review UDC Table 4.8-5 and provide a use that is classified in the UDC along with any applicable Use Specific Standards.

COMMENT: 2-06.4.7.A.6.a - As Irvington Rd is designated as an Arterial on the COT MS&R Map provide a general note stating “THIS PROJECT IS DESIGNED TO MEET THE OVERLAY ZONE(S) CRITERIA, UDC ARTICLE 5.4 MAJOR STREETS AND ROUTES SETBACK ZONE (MS&R)”

2-06.4.7.A.8 - For development package documents provide:

13. COMMENT: 2-06.4.7.A.8.a – Clearly show the building square footage for each building on sheet AS-100.

14. COMMENT: 2-06.4.7.A.8.b – Remove the reference to “LOT COVERAGE” from the plan as it is not applicable, see UDC Table 6.3-5.A.

15. COMMENT: 2-06.4.7.A.8.d – As this site is proposed to be made up of two (2) parcels and each individual parcel cannot stand alone all calculations shall clearly demonstrate that the entire site meets requirements, i.e, the vehicle & bicycle parking shall be based on the total gross floor area not as two separate calculations.

2-06.4.8 - Existing Site Conditions
The following information shall be provided on the plan/plat drawing to indicate the existing conditions on site and within 50 feet of the site. On sites bounded by a street with a width of 50 feet or greater, the existing conditions across the street will be provided.

COMMENT: 2-06.4.8.C – Provide the following information for both Irvington Rd. & 3rd Ave. dimensioned width of paving, curbs, curb cuts, and sidewalks.

2-06.4.9 - Information on Proposed Development
The following information on the proposed project shall be shown on the drawing or added as notes.

16. COMMENT: 2-06.4.9.E - As it appears that some type of land split or plat is proposed, provide the case number adjacent to the title block on all sheets. This process will need to be completed prior to approval of this DP.

17. COMMENT: 2-06.4.9.F - All existing zoning classifications on and adjacent to the project (including across any adjacent right-of-way) shall be indicated on the drawing with zoning boundaries clearly defined.

18. COMMENT: 2-06.4.9.H.5 – Clearly demonstrate how the requirements of UDC Article 7.4.6.H.1 are met for the north side of the vehicle use area northeast of the existing building.

19. COMMENT: 2-06.4.9.H.5 – Fully dimension the required back-up spurs shown at the north ends of the northeast and northwest vehicle use areas.

20. COMMENT: 2-06.4.9.H.5.a – Until comment 12 is addressed Zoning cannot verify vehicle parking requirements. It appears that you have used a general Industrial Use vehicle parking ratio 1/1000 but as Warehouse is considered Commercial Storage this ratio is not correct.

21. COMMENT: 2-06.4.9.H.5.a – It does not appear that accessible parking space calculation is correct for the proposed building. Per the 2018 IBC Chapter 11 Table 1106.1 the required number of accessible spaces is based on the total number of vehicle parking spaces provided, not required.

22. COMMENT: 2-06.4.9.H.5.a – The vehicle parking space calculation shall include the number of required and provided van accessible spaces.

23. COMMENT: 2-06.4.9.H.5.c – Provide a loading zone calculation that provides the number required and provided and the type.

24. COMMENT: 2-06.4.9.H.5.d - Until comment 12 is addressed Zoning cannot verify bicycle parking requirements.

25. COMMENT: 2-06.4.9.H.5.d – The bicycle parking calculation shall clearly show what type of bicycle parking, short- or long-term is required and provided. For either an Industrial or Storage use no short-term bicycle parking is required but the racks shown on detail 6 sheet AS-120 are clearly short-term bicycle parking and do not meet the requirements for long-term bicycle parking.

26. COMMENT: 2-06.4.9.L – As this site is proposed to be made up of two (2) parcels and cross access is proposed some type of easement/agreement is required. Provide a copy of the recorded easement/agreement with your next submittal. Also as this site will be made up of two parcels a Covenant Regarding Development and Use of Real Property will need to be executed. 27. COMMENT: 2-06.4.9.O - Based on recent amendments to the UCD, adopted April 21, 2023, the street perimeter yard setback shown for Irvington Rd. & 3rd Ave. are not correct. Per amended UDC Article 6.4.5.C.2.a, for Irvington Rd. the setback is for nonresidential and multifamily development abutting an Arterial or Collector Street the minimum required street perimeter yard is 10 feet, as measured from the existing or future property line as determined by the adopted Major Streets and Routes Plan, whichever is greater, and per amended UDC Article 6.4.5.C.2.b for 3rd Ave. for nonresidential and multifamily development abutting a Local Street: the minimum required street perimeter yard is twenty feet, as measured from the street property line. 28. COMMENT: 2-06.4.9.R – Per TSM Section 7-01.2.B.2 If the expansion is 25% or more, these provisions apply to the existing use or structure, as well as the expansion. As the proposed building expansion exceeds the 25% clearly demonstrate that all requirements of TSM Section 7 have been met for the entire site.
