THE PROPOSED PLANS HAVE BEEN REVIEWED FOR COMPLIANCE WITH APPLICABLE DEVELOPMENT STANDARDS FOR SITE LANDSCAPE, NATIVE PLANTS, AND RAINWATER HARVESTING, PER-THE-CITY OF TUCSON UNIFIED DEVELOPMENT CODE (UDC), TECHNICAL STANDARDS MANUAL (TSM), AND ADMINISTRATIVE MANUAL (AM).

RESUBMIT REVISED DRAWINGS ALONG WITH A DETAILED RESPONSE LETTER, STATING HOW ALL SITE LANDSCAPE AND NPPO SECTION REVIEW COMMENTS HAVE BEEN ADDRESSED.

SITE LANDSCAPE/NPPO SECTION COMMENTS:

1. The tree plans provided are great. We need one more item to be included in your submittal, the NPPO Waiver. The Waiver formalizes and meet the requirements set forth in the UDC. The following information is for your reference as to why the NPPO Waiver is required as part of the approval process. Copy the link below into your browser and you will find a fillable PDF that will need to be filled out and signed by one of the professionals listed in UDC 7.7.4.D.

2. **A Native Plant Preservation Plan (NPPP) or a NPPO waiver is required per UDC 7.7. See UDC 7.7.3. Applicability; UDC 7.7.4 NPPO General Provisions and Standards; UDC 7.7.4.c. Plan Approval Prior to Permitting; UDC 7.7.4.d. Professional Expertise 7.7.5.c.5; also see AM 2-11.3.0 Permitted Exceptions. If applicable, the Planning and Development Services Department will provide the applicant with the NPPO waiver form upon request.

NOTE: Items below require one of the plant professionals to review and produce and to sign off on all items required by the NPPO Ordinance, (see UDC 7.7.4.D below).

- 3.1. An aerial photograph, taken within a maximum of three years of submittal, of the site at a minimum 1-inch equals 100 feet that delineates the site boundaries and clearly shows the absence of plants within those boundaries or a site plan that clearly shows that construction will not impact any plants. Any aerial photograph submitted, which was taken more than one year prior to submittal, shall be accompanied by a letter stating that the site is substantially unchanged from the date of the aerial photograph.

- 3.2 A signed statement from one of the plant professionals listed in Section 7.7.4.D, Professional Expertise, of the UDC who has visited the site and verified that Viable Protected Native Plants are not located on the subject site.

- 3.3 Other documentation, acceptable to the PDSD Director, which clearly indicates that the site does not contain, or the project will not impact, Protected Native Plants. Such documentation includes, but is not limited to, photographs of the site taken from all sides of the property and a signed statement from the property owner that Protected Native Plants are not located on the subject site.

- 3.4 Based on factors such as the size of the site, site location, topography, and proximity to significant natural features, the PDSD Director may require submittal of specific items above.

3. **UDC 7.7.4.D. Professional Expertise: Preparation of all elements of the Native Plant Preservation Plan and on-site monitoring as required under Section 7.7.5.C.5, On- Site Monitoring, must be performed by a plant professional, such as: 1. An arborist certified by the International Society of Arboriculture; 2. A landscape architect; or, 3. A horticulturist, biologist, or botanist with a minimum B.A. or B.S. in an appropriate arid environment natural resource field.

4. **UDC 7.7.3.D. Exceptions to the Native Plant Preservation Ordinance; The provisions of this section do not apply to the following:

A. Single-family residential development on lots recorded before March 24, 1997, or single-family residential development on a lot within a subdivision that is subject to an approved Native Plant Preservation Plan after the sale and development of a principal structure on that lot;

B. Single-family residential subdivisions for which a tentative plat has been submitted or approved prior to July 1, 1997, per Article 8, Subdivision Standards, provided the plat is recorded within one year from the approval date of the final plat, infrastructure is in place, and 50% of the lots are developed within five years after July 1, 1997.

C. **Projects on a site that does not contain any plant on the Protected Native Plant List as demonstrated by the applicant and subject to approval through procedures established at the Planning and Development Services Department (PDSD). This application can be submitted prior to an applicable review process and approved for an exception on the site. The approved exception is valid for up to one year from the date of the approval; or,

D. **Projects on a site or parcel that contains Protected Native Plants that will not be substantially impacted by development on the site as demonstrated by the applicant per this section and subject to approval through procedures established at the PDSD, provided that construction occurs per the approved plan.

COMMENTS: Please resubmit revised drawings and any redlined plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is February 13, 2027.

SECTION 2-06.0.0: DEVELOPMENT PACKAGE (TENTATIVE PLATS AND SITE PLANS)

CONTENT REQUIREMENTS

2-06.4.2 - The title block shall include the following information and be provided on each sheet:

2-06.4.2.D - The page number and the total number of pages in the package (i.e., sheet xx of xx).

1. COMMENT: 2-06.4.2.D – Sheet 1 refers to page 1 of 4 however there are 6 sheets with this submittal. Please ensure the page number and total number of pages correctly reflect what is submitted as noted by the standard above.

2-06.4.3 - The administrative street address and relevant case numbers (development package document, subdivision, rezoning, board of adjustment, DDO, MDR, DSMR, overlay, etc.) shall be provided adjacent to the title block on each sheet.

2. COMMENT: 2-06.4.3 - Provide the development package number, TD-DEV-0226-00036, adjacent to the title block on each sheet.

2-06.4.5 - When the development package documents consists of more than one sheet, a sheet index (a legible drawing of the site showing the area represented on each sheet) is to be placed on the cover sheet or the second sheet.

3. COMMENT: 2-06.4.5 – The sheet index provided refers to only 4 sheets however there are 6 sheets included with this submittal. Please ensure the sheet index correctly reflects what is being submitted as noted by the standard above.

The Use Specific Standards associated with Administrative & Professional Office in the C-1 zone are 4.9.13.O. Please update the notes to include this information.

2-06.4.7.A.8 - For development package documents provide:

2-06.4.8 - Existing Site Conditions
The following information shall be provided on the plan/plat drawing to indicate the existing conditions on site and within 50 feet of the site. On sites bounded by a street with a width of 50 feet or greater, the existing conditions across the street will be provided.

2-06.4.8.A - Provide site boundary/subdivision perimeter information, including bearing in degrees, minutes, and seconds, with basis for bearing noted, together with distances in feet, to hundredths of a foot, or other functional reference system.

6. COMMENT: 2-06.4.8.A – The property dimensions provided are incorrect. The Southwest and Northwest property corners are radiused and not shown correctly on the site plan. 2-06.4.9 - Information on Proposed Development
The following information on the proposed project shall be shown on the drawing or added as notes.

2-06.4.9.H.4 - Indicate if existing streets are public or private; provide street names, widths, curbs, sidewalks, and utility locations, all fully dimensioned.

7. COMMENT: 2-06.4.9.H.4 – Indicate both S. Treat Avenue and E. Broadway Boulevard are both “Public Streets” as noted by the standard above.

2-06.4.9.H.5 - If utilizing parking area access lanes (PAALs), they shall be designed in accordance with Section 7.4.6, Motor Vehicle Use Area Design Criteria, of the UDC.

8. COMMENT: 2-06.4.9.H.5 – Per Site Engineering comments, “To review for compliance with UDC 7.4.6.F.2 & UDC 7.4.6.E.2. It is required that the the canopy either follow the required height clearance of 15’ or be setback 1’ or greater from the PAAL. Provide a height call-out showing the clearance or show on the site plan that the 1-foot setback is addressed.”
2-06.4.9.O - All applicable building setback lines, such as erosion hazard, floodplain detention/retention basins, and zoning, including sight visibility triangles, will be shown.

9. COMMENT: 2-06.4.9.O – UDC 6.4.5.C.2.b states “For nonresidential and multifamily development abutting a local street, the minimum required street perimeter yard is 20’ as measured from the property line. S. Treat Avenue is considered a local street. The proposed “Canopy 1” is only 8.34’ from the property line. Either move the canopy to meet the minimum street setback or apply for a Design Development Option (DDO) to reduce the minimum required street setback to 8.34’. Please apply for your DDO as a sub record (zoning modification) in the permit workflow.
