1. In accordance with Sec 10-01.3.3 of the UDC Technical Standards (UDC TSM) Manual, a continuous unobstructed pedestrian circulation path along projects property street frontage must be provided. Any existing pedestrian facilities along the property frontage shall be brought into compliance with Sec. 10-01.4.0. of the UDC TSM. This includes replacing any out of compliance curb access ramp and replacing any sidewalk sections that are broken/cracked or where the cross slope exceeds 2%.

2. Per Sec. 6.3.2 of the Transportation Access Management Guidelines for the City of Tucson, a Traffic Impact analysis will be required for this development.

This plan has been reviewed for compliance with applicable development criteria in the City of Tucson Unified Development Code (UDC) Administrative Manual (AM) Section 2-11 and Technical Manual (TM) Section for landscape, native plants, and water harvesting.

Please resubmit revised drawings along with a detailed response letter, which states how all of the Site Landscape/NPPO Section review comments have been addressed.

SITE LANDSCAPE/NPPO SECTION COMMENTS:

1. Thank you for submitting a clear and coordinated set of site landscape development plans.

2. Use a slightly heavier line weight for the ROW and property line on the landscape plan sheets.

3. The property line/ROW line is crossing the parking area at the northeast. DTM review and approval is required for the planting, irrigation and WHIA basin(s) located in the ROW. Please reach out to David Marhefka, PLA (david.marhefka@tucsonaz.gov) for review and approval. A letter or email correspondence with David’s approval will be required prior to site landscape approval. I have added Transportation Landscape Review to expedite the review process. Reach out to David directly to coordinate his approval of the ROW landscape. Please allow a few extra days beyond the due date of 4/3/25 for Transportation Landscape review.

4. If WHIA basins are proposed in the ROW/Future ROW, they can not be counted towards the 50% requirement for the Commercial Rainwater Harvesting Ordinance. It is fine to have the basins in the ROW with David’s permission, the SF area numbers should not be part of the plant water demand spreadsheet.

5. Can “OR APPROVED EQUAL” be added to the note with regard to the ¾” screened rock?

6. Call out the parking lot/street landscape border screen wall height and material and provide a detail for the wall on the landscape details sheet. Including the footing because it is directly adjacent to a WHIA basin. Civil note 36 on sheet 4 of 16 calls out some details about the wall but refers to the landscape plans for the rest of the details.

7. A couple of the Dalea Greggii have been accidentally placed in conflict with the 30” screen wall. Revise as necessary.

8. The Benson Hy Street Landscape Border coverage provided is low. Can a few more accents/groundcovers/shrubs be added to get closer to the required SF of vegetative groundcover?

9. The CRWH plan has plenty of detail which is great. Can a general note be added to the CRWH plan that states something along these lines: “if there are discrepancies between the rainwater harvesting plan and the civil grading plan to reach out to both the civil engineer and landscape architect of record for clarification.”

10. A couple of the WHIA basins have some hard angled corners. Can radii be added to those corners so that the contractor doesn’t try to construct the basins with difficult to form corners?

11. Prior to Site Landscape Development Package approval, please make sure Site Zoning, Site Engineering and DTM comments are fully addressed.

This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also, compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM).

Section 3.3.3.G.5.c UDC, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One-year Expiration date is March 10, 2026.

Thank you for the opportunity to comment on TD-DEV-0225-00051, 1
st Submittal, a
development plan for a new marijuana dispensary at 880 E Benson Highway. This
development is located in the S.W. quarter of the S.W. quarter of Section 30, Township 14S,
Range 14E, of the Gila and Salt River Meridian. The development site occupies parcel number
132-14-024B, covers approximately 0.71 ± acres, and is zoned as Commercial 2 Zone (C-2).
The nearest major roadway intersection is East Benson Highway and South Park Avenue,
approximately 50 feet to the northeast of the subject development.
This site does lie within the Tucson International Airport avigation easement requirements and
public disclosure area, FAA traffic pattern airspace, and FAA Part 77 airspace.
The Tucson Airport Authority approves the proposed project and is not requiring a resubmittal of
this project.
Although this project does not propose a change in plan designation or zoning the Tucson
Airport Authority highly recommends the applicant add the following notes into the general notes
of the revised development plan. This project is located approximately 3.3 miles northwest of
Tucson International Airport and is within FAA traffic pattern airspace, an area which would be
subject to aircraft overflight and noise due to being in close proximity to Tucson International
Airport.
The proposed notes would provide a means of assuring that future owners and tenants of the
property are aware they are in proximity an airport and further assures the continued right of the
City of Tucson, Tucson Airport Authority, and all persons lawfully utilizing the Tucson
International Airport the right to utilize the airspace above or near the property. This would be
accomplished through the property owner recording the Avigation Easement and providing the
Airport Disclosure Statement to the new residents of all residential uses. The Tucson Airport
Authority believes the proposed note helps to support the City of Tucson Airport Environs
Overlay Zone and supports Plan Tucson – Regional and Global Positioning policy 4 (RG-4).
1."That prior to the City's approval of the proposed development, the property owner
must record the Avigation Easement that discloses the existence and operational
characteristics of the Tucson International Airport to future owners or tenants of the
property and further conveys the right to the public to lawfully use the airspace above the
property. The Avigation Easement shall be recorded in a manner with the Pima County
recorder which shall document it as having title liability. The content of such documents
shall be according to the form and instructions provided.”
The current property owner or person authorized to sign on behalf of the current property owner
must complete, sign, and record the Avigation Easement. Please record the Avigation
Easement with the Pima County Recorder’s Office. Then send a complete copy of the recorded
easement document to Tucson Airport Authority by either email (send to

“The property owner/developer/applicant must provide the Airport Disclosure Statement
form, at time of sale, to the new property owners with all new unit purchases. In the
event the development of any residential uses does not involve the sale of new units but
is instead offering rental residential units to the public, the new tenant of the rental unit
must be provided a copy of the Airport Disclosure Statement form. The intent of the
Airport Disclosure Statement form is to educate and notify the new residents that they
are living near an airport. The content of such documents shall be according to the form
and instructions provided.”

plan submitted 3/12/2025. There are existing facilities within the development which are
depicted upon the plan; however, there are no apparent conflicts at this time.
Enclosed is a copy of a TEP facilities map showing the approximate location of the
existing facilities. Any relocation costs will be billable to the customer.
To apply for electric service, please call the New Construction department at (520) 918-
8300. Please submit a final set of plans including approved site, electric load, paving
off-site improvements and irrigation plans. If available, include a PDF version of the
plans.
If easements are required, they will be secured by separate instrument. Should you
