The Development Package included in the DEV only shows the On-Site improvements.
The Off-Site Improvement Plans still need to be provided as a part of this DEV.
The SB RTL should be maximized within the space available.

Regarding TD-DEV-0225-00041, the City of Tucson Parks and Recreation Department will require construction of the adjacent section of the Kolb South Greenway.

The Tucson Mayor & Council-approved "Pima Regional Trails System Master Plan" (PRTSMP) indicates the need for the design and construction of the Kolb South Greenway (G029) adjacent to this parcel. See document page 106 for a brief description of the Kolb South Greenway and see document page(s) 61-64 for Greenway design criteria. A minimum 50’ Non-Motorized Public Trail Easement/corridor width is required along with design and construction of the Greenway.

All design and construction are to be to City of Tucson Parks and Recreation or Tucson Department of Transportation and Mobility standards, and all work is to be approved by representatives of both departments. An in-lieu fee option for design and construction can be calculated and discussed if preferred.

Thank you for the opportunity to comment on TD-DEV-0225-00041, 1
st Submittal, a
development plan a new gas station at 6930 E Camino Boleadoras. This development is
located in the S.E. quarter of the N.E. quarter of Section 19, Township 15S, Range 15E, of the
Gila and Salt River Meridian. The development site occupies parcel number 141-36-6950,
covers approximately 1.69 ± acres, and is zoned as Planned Area Development 7 (PAD-7). The
nearest major roadway intersection is East Camino Boleadoras and South Kolb Road,
approximately 50 feet to the northeast of the subject development.
This site does lie within the Tucson International Airport avigation easement requirements and
public disclosure area, FAA traffic pattern airspace, and FAA Part 77 airspace.
Below are the responses that the FAA Notice Criteria Tool provided on the applicant’s project.
1. Your proposed structure exceeds an instrument approach area by 22 feet and
aeronautical study is needed to determine if it will exceed a standard of subpart C of
14CFR Part 77. The FAA, in accordance with 77.9, requests that you file.
2. Your proposed structure is in proximity to a navigation facility and may impact the
assurance of navigation signal reception. The FAA, in accordance with 77.9, requests
that you file.
3. The FAA requests that you file
The Tucson Airport Authority is requiring a resubmittal of this project.
Conditions of approval:
1. “The applicant shall file FAA Form 7460 with the FAA at least 45 days before
construction activities begin unless FAA staff, with the Obstruction Evaluation / Airport
Airspace Analysis (OE/AAA), provides the project applicant with written communication
that filing FAA Form 7460 is not required. It is highly recommended that the applicant
file earlier than 45 days to provide the applicant with sufficient time to respond to any
concerns which are identified by the FAA. Any cranes which are used must also be
identified with Form 7460. Please file Form 7460 at
Although this project does not propose a change in plan designation or zoning the Tucson
Airport Authority highly recommends the applicant add the following notes into the general notes
of the revised development plan. This project is located approximately 2.25 miles northeast of
Tucson International Airport and is within FAA traffic pattern airspace, an area which would be
subject to aircraft overflight and noise due to being in close proximity to Tucson International
Airport.
The proposed notes would provide a means of assuring that future owners and tenants of the
property are aware they are in proximity an airport and further assures the continued right of the
City of Tucson, Tucson Airport Authority, and all persons lawfully utilizing the Tucson
International Airport the right to utilize the airspace above or near the property. This would be
accomplished through the property owner recording the Avigation Easement and providing the
Airport Disclosure Statement to the new residents of all residential uses. The Tucson Airport
Authority believes the proposed note helps to support the City of Tucson Airport Environs
Overlay Zone and supports Plan Tucson – Regional and Global Positioning policy 4 (RG-4).
1."That prior to the City's approval of the proposed development, the property owner
must record the Avigation Easement that discloses the existence and operational
characteristics of the Tucson International Airport to future owners or tenants of the
property and further conveys the right to the public to lawfully use the airspace above the
property. The Avigation Easement shall be recorded in a manner with the Pima County
recorder which shall document it as having title liability. The content of such documents
shall be according to the form and instructions provided.”
The current property owner or person authorized to sign on behalf of the current property owner
must complete, sign, and record the Avigation Easement. Please record the Avigation
Easement with the Pima County Recorder’s Office. Then send a complete copy of the recorded
easement document to Tucson Airport Authority by either email (send to

form, at time of sale, to the new property owners with all new unit purchases. In the
event the development of any residential uses does not involve the sale of new units but

must be provided a copy of the Airport Disclosure Statement form. The intent of the
Airport Disclosure Statement form is to educate and notify the new residents that they
are living near an airport. The content of such documents shall be according to the form

This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also, compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM).

Section 3.3.3.G.5.c UDC, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One-year Expiration date is February 12, 2026.

5. COMMENT: 2-06.4.9.H.5.d – Development Package Calculation #5 Short-term bicycle parking Total Provided states “2 PROVIDED (INSIDE BUILDING). Per UDC Article 7.4.9.C.2.b short-term bicycle parking shall be located outside the building. Also, sheet 6 Site Keynote 2 shows the short-term bicycle located outside near the southeast corner of the building.

6. COMMENT: 2-06.4.9.H.5.d – Clearly addressed how the requirements of UDC Article 7.4.9.B.1.e are met.

7. COMMENT: 2-06.4.9.H.5.d – Clearly show the long-term bicycle parking on the plan and provide a detail that clearly demonstrates that the requirements of UDC Article 7.4.9.D are met.

8. COMMENT: 2-06.4.9.O – Development Package Calculation #3 Setbacks, “STREET YARD” is not correct. Review PAD-7 Section III.5.b).3 page 45 and provide the correct street setback requirement.

9. COMMENT: 2-06.4.9.Q – Development Package Calculation #2 Height, “MAXIMUM PERMITED”” is not correct. Review PAD-7 Section III.5.b).4 page 45 and provide the correct maximum building height..

10. COMMENT: 2-06.4.9.R – Clearly demonstrate that the requirements of TSM Section 7-01.3.3.A & 7-01.4.1.A are met. Zoning acknowledges that you are requesting a TSMR to eliminate the sidewalk out to Kolb Rd. But as there is sufficient space to provide a sidewalk out to Kolb along the south property line Zoning does not recommend approval of this TSMR.
