COMMENTS: Please resubmit revised drawings and any redlined plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM).

Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One-year Expiration date is May 10, 2025.

2-06.4.0 Content Requirements:

1. 2-06.4.7.A.4 - Identify the existing and proposed use of the property as classified per the UDC. List all UDC sections applicable to the proposed uses.

COMMENT: This comment was not completely addressed. Provide the existing use, Commercial-Food Service, in the Site Date section on the Cover Sheet. The Applicable Use Specific Standards are UDC 4.9.4.M.1 and 4.9.13.P.

2. 2-06.4.9.H.5.a - Show all motor vehicle off-street parking spaces provided, fully dimensioned.

COMMENT: The following comments are still applicable, as the requested Parking Design Modification Request was denied. If the required amount of parking cannot be met an Individual Parking Plan will be required.

COMMENT: The required amount of parking is not being met. Per the last approved site plan for the site 44 spaces are required with 2 accessible spaces, one of which needs to be van accessible.

COMMENT: Per UDC Article 7.4.6.D.1, the minimum parking space size is 8.5’x18’. The compact spaces shown on the Site Plan do not count towards meeting the minimum parking requirement.

COMMENT: Zoning acknowledges a Parking Design Modification Request (PDMR) was applied for to reduce the amount of required parking spaces, and reduce the required parking space size to allow the proposed Compact spaces to count towards the required amount of parking spaces.
The PDMR can be applied for to reduce the required amount of parking spaces by up to 5 spaces, for a potential of 39 spaces required, if approved.

COMMENT: As the PDMR was not approved to allow for the compact spaces as shown on the site plan. An Individual Parking Plan (IPP) can be used to reduce the amount of required parking further. Contact Mark Castro at Mark.Castro@tucsonaz.gov for more information on the IPP process.


COMMENT: Zoning cannot approve of this permit until the required amount of parking is met through a PDMR or IPP process, or reconfiguration of the site to meet parking requirements.

05/17/2024 TSMR/PDMR - Zoning REQUIRES RESUBMIT Zoning acknowledges the reduction in parking space length for the proposed "compact" spaces is within what is allowed for a PDMR. However, there reduced length is likely to create a conflict with the adjacent access lane for customers exiting the site.

Zoning has no objection to the request to reduce the total number of parking spaces provided.

A resubmittal of the development package is required.
