Thrall (Heather.Thrall@tucsonaz.gov) Date: 03/17/2023 Codes: Unified Development Code (UDC) 7A Sign Standards 1. There is an existing nonconforming pole sign at the east end of the site. While this is a change of use from retail to restaurant, and nonconforming pole signs shall either be removed or shall be brought into conformance with the code, there is another option here to consider. The sign qualifies for a Heritage Landmark Sign (HLS) process, given it may be restored, is older than 1974, has an irregular shape and contained neon for the original "El Rancho Market". The neon is said to remain intact under the present paneling on the sign faces. An HLS does not count toward the total number of freestanding signs, nor towards the location's allowed sign area. In addition, it may be that depending on design, it is possible to consider that a portion of the sign could have an adaptive re-use to include the new user - Starbucks, and retain character defining features and character defining text for the sign. In addition, the sign can be relocated elsewhere on the site, under certain criteria, under the HLS process. You may review 7A.10.5. of the UDC for Heritage Landmark Signs for additional criteria.: https://codelibrary.amlegal.com/codes/tucson/latest/tucson_az_udc/0-0-0-27095 While it appears that this sign may be required to be removed from present location due to the drive thru lane position shown on the development package, it may be of interest to your client still to consider the HLS process for this sign and relocate it elsewhere onsite. If not, there most certainly may be others that have interest in the sign and would wish to be involved in preserving it. If your client desires to consider the HLS process, staff would facilitate the research into original documents for the sign permit and provide information for the historic review process for actual designation. This plan has been reviewed for compliance with the Unified Development Code (UDC), Administrative Manual (AM) Section 2-06, and the Technical Standards Manual (TSM). Per UDC Section 3.3.3.G.5.c, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is March 15, 2024. 1.
