COMMENTS:

1. The water service line may not be shared between parcels. Tucson Water’s Remote Meter Policy No. IV-B.08, Eff. 07/14/2009 requires all of the following:
a. Each lot must have its own water meter.
b. The water meter for any given lot must lie within that lot’s frontage onto a public street, private street, or utility easement that contains an existing water main that can serve that lot.
c. The private water line from a water meter to building must lie on just one lot. The private water line from a water meter to a building may not encroach into, or cross a second lot, even in a private water easement.
2. An appeal to the Building Official shall be submitted at the time of building permit application to allow the sewer connection to be shared between the two lots. Reference: Section 701.3, IPC 2024.
3. Please show the FFE, finished floor elevation, and the RIM elevation of the nearest upstream manhole on the site plan. Reference: Section 714.1, IPC 2024, as amended by the City of Tucson.
a. Will be used to confirm whether a backwater valve is required
4. If the lots/parcels are combined into a single lot, the existing water meter may remain, and an appeal for a shared sewer connection will not be required.

COMMENTS: Please resubmit revised drawings and any redlined plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is January 26, 2027.

SECTION 2-06.0.0: DEVELOPMENT PACKAGE (TENTATIVE PLATS AND SITE PLANS)


1. COMMENT: Zoning could not find a Certificate of Occupancy (CofO) on record for Marymar Events. Please include a copy on the next submittal. If one cannot be provided,
a. this site may be eligible for the issuance of a CofO if it meets the criteria in UDC 3.3.3.H: Zoning Compliance for Site Improvements in Existence on May 1, 2025, or
b. it will be considered a Change of Use and will require full code compliance for the entire site (Parcels 13219017B and 132190130)

2. COMMENT: The site will require a lot combination of Parcels 13219017B and 132190130 processed through Pima County Assessors: www.asr.pima.gov/Downloads/Forms/ComboRequest.pdf.

2-06.4.3 - The administrative street address and relevant case numbers (development package document, subdivision, rezoning, board of adjustment, DDO, MDR, DSMR, overlay, etc.) shall be provided adjacent to the title block on each sheet.

3. COMMENT: 2-06.4.3 - Provide the development package case number, TD-DEV-0126-00016, adjacent to the title block on each sheet.

2-06.4.7.A.2 - List the gross area of the site/subdivision by square footage and acreage.

4. COMMENT: 2-06.4.7.A.2 – The gross area of the site shall include both parcels (13219017B and 132190130). Correct total SF/acres under Zoning and Land Use Notes and Development Package Calculations (Sheet 1).

2-06.4.7.A.4 - Identify the existing and proposed use of the property as classified per the UDC. List all UDC sections applicable to the proposed uses.

5. COMMENT: 2-06.4.7.A.4 – The existing Use (Marymar Events) is considered “Civic Assembly.” The proposed Use is “Food and Beverage Sales.” Please correct under Zoning and Land Use Notes (Sheet 1).

2-06.4.7.A.8.b - Percentage and area in square feet of building and accessory building coverage;

6. COMMENT: 2-06.4.7.A.8.b – Provide the information as listed in the standard above. Clarify where the “957 SF Outdoor Seating” area is on the site plan.

2-06.4.7.A.8.c - Percentage of building, lot area, or vehicular use area expansion. If the building(s) or lot area have been previously expanded, those calculations shall be included; and,

7. COMMENT: 2-06.4.7.A.8.c - Provide the information as listed in the standard above.

2-06.4.7.D - Utilities Note
All development package documents are to include the following note: "Any relocation or modification of existing utilities and/or public improvements necessitated by the proposed development will be at no expense to the public."

8. COMMENT: 2-06.4.7.D - Add the note that is listed in the standard above.

2-06.4.8.C - The following information regarding existing private or public right-of-way adjacent to or within the site shall be provided: the name, right-of-way width, recordation data, type and dimensioned width of paving, curbs, curb cuts, and sidewalks.

9. COMMENT: 2-06.4.8.C – Draw and dimension width of curbs, curb cuts, and sidewalks.

2-06.4.9.H.5.a - Show all motor vehicle off-street parking spaces provided, fully dimensioned. As a note, provide calculations on the number of spaces required (include the ratio used) and the number provided, including the number of spaces required and provided for the physically disabled. The drawing should indicate parking space locations for the physically disabled. A typical parking space detail shall be provided for both standard parking spaces and those for the physically disabled. For information on parking requirements for the physically disabled, refer to adopted building and accessibility codes of the City of Tucson. Design criteria for parking spaces and access are located in Section 7.4.6, Motor Vehicle Use Area Design Criteria, of the UDC.

10. COMMENT: 2-06.4.9.H.5.a – Parking calculations are incorrect. Recalculate using the Uses listed in Comment 5. Calculate the required parking for Marymar Events using the total SF (primary structure, accessory storage buildings, and outdoor seating).

2-06.4.9.H.5.d - Show bicycle parking facilities fully dimensioned. For specifics, refer to Section 7.4.9, Bicycle Parking Design Criteria, of the UDC. Provide, as a note, calculations for short and long term bicycle spaces required and provided.

11. COMMENT: 2-06.4.9.H.5.d – If a Change of Use is required (per Comment 1), bicycle parking requirements apply for Marymar Events. Add calculations to Sheet 1 and indicate locations on the site plan.

2-06.4.9.O - All applicable building setback lines, such as erosion hazard, floodplain detention/retention basins, and zoning, including sight visibility triangles, will be shown.

12. COMMENT: 2-06.4.9.O – Draw and dimension setbacks for all structures on site.

2-06.4.9.R - Show on-site pedestrian circulation and refuge utilizing location and the design criteria in Section 7-01.0.0, Pedestrian Access, of the Technical Standards Manual.

13. COMMENT: 2-06.4.9.R - If a Change of Use is required (per Comment 1), a pedestrian circulation path is required to connect all areas of development on-site and to any adjacent street frontage.
