This plan has been reviewed for compliance with the Unified Development Code (UDC), Administrative Manual (AM) Section 2-06, and the Technical Standards Manual (TSM). Per UDC Section 3.3.3.G.5.c, an applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year expiration date is July 20, 2024. 1. COMMENT: 2-06.4.7.A.4 – This comment was not entirely addressed. State that the proposed use is subject to use-specific standards 4.9.4.M.1 and .5, and 4.9.13.O. 2. COMMENT: 2-06.4.9.H.5.a – This comment was not entirely addressed. While the parking space cross both parcels was removed, as shared access is proposed between the Taco Bell and Circle K developments, a site plan showing both developments shall be submitted. Provide a recorded cross access agreement demonstrating shared access between both parcels. 3. COMMENT: 2-06.4.9.H.5.d – This comment was not entirely addressed. Ensure the proposed short- and long-term bicycle parking meets the requirements of UDC 7.4.9. Specifically, demonstrate how the proposed facilities comply with UDC 7.4.9.B.1.e, 7.4.9.C.2.a, and 7.4.9.D.5.
