01/08/2026 Residential Zoning REQUIRES RESUBMIT PDSD TRANSMITTAL

PROJECT: TC-RES-1225-06127
4137 E Oxford Dr., Tucson, AZ 85711
Partial Garage Conversion to Sleeping Quarters (1st Review)

TRANSMITTAL DATE: 01/08/2026

This site is located within the R-1 zone (UDC 4.7.8). A single-family residence is a permitted use in this zone (Table 4.8-2) subject to Use Specific Standards 4.9.7.B.5 - .9.

RESUBMITTAL OF THE FOLLOWING IS REQUIRED: Correct plans, as noted in the comments below, along with a response letter indicating how all Site Zoning comments were addressed.
Below is a list of requirements specific to your project.

1. Sheet CS refers this project as an unpermitted studio build-out. The City of Tucson codes would label this either a ‘sleeping quarters or an ADU. In Tucson, accessory sleeping quarters or guest houses are allowed, providing other regulations are met. However, a full kitchen in the unit is not permitted, as sleeping quarters are not intended to be a self-contained unit. Such unit would be allowed to have a small under-the-counter refrigerator but no oven/stove. Since January 2022, Tucson has permitted ADUs in zones that allow residential uses. More than a sleeping quarters, an Accessory Dwelling Unit (ADU) also referred to as a ‘Casita’ is permitted to have an independent kitchen (with a full refrigerator and stove/oven) as well as its own ADA compliant 4’ wide, dust free surface pathway to a public right of way, entrance, bathroom, living and sleeping space. ADU’s are assessed impact fees and need to have their own address assigned by Pima County. On a site plan, for example, an ADU would be referred to as “Unit 2” and the primary residence would be considered and labeled ‘Unit 1.” Revise the site plan to delete all references of the unit as a ‘studio’ and label the newer area in the garage as either an ADU or a Sleeping Quarters.

2. Provide the total lot coverage. This excludes open structures and includes vehicular use areas and all enclosed structures divided by the lot’s total square footage. The maximum lot coverage allowed per UDC Table 6.3-2 is 70%.

3. The conversion from the garage to sleeping quarters or ADU triggers the need for either of the following actions:

a. A neighbor approval since the structure sits within the 6’ required perimeter setback to the west. Neighbor approval is completed when a block is added directly to the site plan. The approval would state something similar to the following: I/We, ___________ are the owners at 4131 Oxford Dr. I/We have reviewed the site plan and have no objections to the building being 0’ from the west side setback. Signed :___________ Date: ______________.

b. A Design Development Option (DDO) if a neighbor approval is unable to be obtained. To submit an application for a DDO, please resubmit the package using the link and follow the instructions below:

www.tucsonaz.gov/files/sharedassets/public/v/1/pdsd/documents/planning-amp-zoning/ddo-for-setback-and-height.pdf Submit a DDO application under the Zoning Modification sub-record that you will create . Until either a. or b. above is provided, Site Zoning is unable to move forward on the permit approval.
