Permit cannot be approved with fence blocking the right-of-way. 2. Fences over 7’ tall require a design from the foundation to the highest point sealed by an Arizona registered engineer. 01/15/2025 | Site Zoning | REQUIRES RESUBMIT | FROM: PDSD Zoning Review Section PROJECT: TC-RES-1224-07325 - CE-VIO1024-04080 1201 W PELAAR ST. – R-1 8’ Tall Wood Fence Building in ROW (1st Review) TRANSMITTAL DATE: January 15, 2025 Comment: Provided a detailed comment response letter with your submittal that clearly shows how you have addressed all comments with your next submittal. This site is located in the R-1 zone (UDC 4.7.8). A single-family residence is a permitted use in this zone (Table 4.8-2) subject to Use Specific Standards 4.9.7.B.5 – 9. 1. Provide a residential plot plan that meets all requirements found at: https://www.tucsonaz.gov/Departments/Planning-Development-Services/Building-Safety/Plan-Examples/Plot-Plan-Example. Clearly show the property lines and fence location. Based the aerial photo provided the fence is located within the COT right-of-way, alley. 2. Per UDC Article 6.6.2.I. The maximum height of a wall or fence within a perimeter yard shall be six feet; however, the wall or fence may be higher than six feet, but no higher than ten feet, if: (See Figure 6.6.1-A, Height of Wall or Fence within a Side or Rear Perimeter Yard .) 1. At least 75% of the area above six feet in height is left unobstructed and open through the use of architectural elements, such as arches, columns, or wrought iron; 2. Part of, or located on top of, a retaining wall no higher than ten feet measured from design grade and no higher than six feet measured from the top of the retaining portion of the wall; 3. A greater height is required through the rezoning process or the special exception land use process; or, 4. A greater height is required by a specific UDC standard. Either demonstrate that one of the 4 exceptions are met or a Design Development Option (DDO) must be approved for a wall height to exceed the allowed 6’-0”. 3. Based on aerial photos there has been an addition to the southeast corner of the single family residence (SFR) that appears sometime after 2016. Zoning was not able to find approved permit documents for this addition. Either provided stamped approved permit documents of a permit will need to be applied for and approved prior to approval of this fence permit. The unpermitted addition may be submitted as part of the fence permit as long as building plans are provided.
