A single-family residence with an Accessory Dwelling Unit is permitted use in this zone (Table 4.8-2) subject to Use Specific Standards 4.9.7.B.5 - .9, and 6.6.3. 1. COMMENT: PER UDC 6.3-2.B, in the R-2 zone, the allowable density is one unit per 2,904 square feet. With lot size of 5,000 square feet of second unit will not be permitted as shown. An additional unit would have to be an Accessory Dwelling Unit (ADU) and follow the ADU standards found in UDC Article 6.6.3.B. The main ADU requirement that will be problematic for the proposed unit is; on sites where the principal structure is one story, accessory dwelling units shall not exceed 12 feet in height (UDC 6.6.3.B.4). A Board of Adjustment Variance process will need to be applied for and approved to allow for the proposed height of the ADU as shown. COMMENT: Per UDC Table 6.3-2.A, the required setback in the R-2 zone is the greater of 6 feet or 2/3 the height of the proposed building wall. Based on a proposed wall height of 18 feet, the required perimeter yard setback to the north property line is 12 feet. The proposed setback is 4 feet 8 inches. Add the required setbacks to the site plan on the next submittal. The proposed ADU encroaches into the required side yard setback. A Design Development Option must be applied for and approved before this permit can be approved by Zoning. COMMENT: As the proposed height of the ADU will require a Variance process, the setback reduction can be processed through the Variance process instead of the DDO process. If the ADU can be redesigned to be in conformance with the maximum 12 feet standard, only the DDO process will be required to reduce the setbacks.
