This site is located within the R-2 Zone (UDC 4.7.9). A single-family residence is a permitted use in this zone (Table 4.8-2) subject to Use Specific Standards 4.9.7.B.6, .9, & .10.

RESUBMITTAL OF THE FOLLOWING IS REQUIRED: Please correct plans, as noted in the comments below, along with a response letter indicating how all Site Zoning comments were addressed.

1. Per the City of Tucson Unified Development Code (UDC) Sec. 6.6.3.C, an accessory dwelling unit (ADU) would not be allowed in the front yard of the principal residence: “Detached accessory buildings, including accessory dwelling units, are not permitted in the buildable area extending the full width of the lot between the principal building and the front street lot line…” The path forward may be one of two ways, a). through a Board of Adjustment Variance, or b.) by attaching the ADU to the residence:

a. The Board of Adjustment has the authority to approve variances from the UDC, (UDC 3.10.3.A.1). Approval from UDC 6.6.3.C must be obtained through a Board of Adjustment variance before the permit can be approved by Zoning. If the variance route is selected, include the BofA decision letter with the resubmittal packet.

OR,

b. By attaching the ADU to the primary residence, there is no need for a variance.

2. The proposed ADU is located within the 5’ perimeter rear and north side setbacks. A Design Development Option is required whether the ADU is attached or not. 3. 4. The lot coverage is incorrect and reflects the lot coverage for the residence being permitted under TC-RES-0925-04576. Porches are not included in the calculations for lot coverage. By adding the square footage of the new guest house (400) to the primary residence (947) and the driveway area (476), the total lot coverage will be 57%, within the maximum lot coverage allowed in the R-2 zone – 70%.

5. Please be advised that the ADU will not be able to be constructed until the primary residence has been constructed.
