TRANSMITTAL DATE: December 23, 2025

This site is in the R-1 Residence Zone (UDC 4.7.8). A single-family residence is permitted use in this zone (Table 4.8-2) subject to Use Specific Standards 4.9.7.B.5 - .9 for 1 unit; 4.9.7.B.1 - .9, & .11 for 2 units (min. 10,000 sq ft lot size required).

Plan review for the above referenced carport has been completed. This letter reflects comments to be addressed. For facilitating a shorter back check time, please provide updated plans and calculations with a written response to each of the notated items indicating action taken. Do not cloud the changes made for comment updates; revisions are processed if changes occur after the permit is issued.

1. COMMENT: The site plan provided is incomplete.

a) Provide a site plan that meets the requirements show in the plot plan example at the following link:

More Specifically:

1) Draw and label 5’-0” wide utility easement inside the north property line. Currently, the other half the 10’-0” easement is shown north of the property line. Ensure you site the carport out of the 5’-0” utility easement. If you cannot achieve this, you will need to obtain written approval from all the utility purveyors utilizing this easement.

2) Draw and label all setbacks. Setbacks for side and rear property lines are 6’ or 2/3 the height of any structure flanking the north, west and east property lines, whichever is distance is greater. The front yard setback is 20’-0” (facing E Montecito St).

3) Draw and label vehicular use areas (driveway, parking spots).

4) Label everything that exists on the property (walls, fences and provide heights measured from above finish grade at various locations along the fence/wall) if applicable.

5) Include all the drawings previously submitted along the revised site plan (carport drawings).


2. COMMENT: Property is over 50 years of age. The Pima County Assessor’s effective construction date for your house is 1952. The actual construction date may be earlier. Per UDC 3.12.1, building, portions of buildings, or structures that are 50 years of age or older must be architecturally documented prior to demolition. Documentation will be reviewed and approved by the Historic Preservation Office before a permit is issued. Please submit the completed documentation under the permit number via your TDC online account. Minor historic demolition documentation is required. Until the Historic review is completed and approved, Zoning cannot approve this demolition permit.

3. COMMENT: Per TABLE 6.3-2.A of the UDC (referenced below), the perimeter yard setback(s) along the north, east, and west property line(s) are 6’ or 2/3 the height of the utility shed, WHICHEVER DISTANCE IS GREATER. Depending on how far the proposed carport sits off the north and east property lines, three options exist:

a) 1’-0” or more or 1-0” OR Less (encroaching in setback):

b) 1’-0” or more from property line and unable to obtain neighbor waiver:
Should you be unsuccessful in your attempt to retrieve the neighbor waiver there is a Design Development Option (or DDO) which affords an attempt to seek relief from the setback requirements. Know this is an extra 6-week review and the neighbors within 100’-0” are made aware of this attempt to seek relief from being in the setback. Zoning will not be able to approve the permit application until the DDO is approved. This information is linked here:

c) Less than 1’-0” from property line and unable to obtain neighbor waiver:
Should you be unsuccessful in your attempt to retrieve the neighbor waiver, a board of adjustment variance will be required to permit the carport as shown on the site. See variance requirements below. Zoning cannot approve this permit until the Board of Adjustment (B/A) Variance Process is completed and approved.
