(Comment) Per UDC Section 6.4.4., wall and building heights are measured from design grade. Provide height on elevation sheets measured from design grade. 2. (Comment) Label all setback distances (including from walk-up stairs to W 18th St) to adjoining property lines. 3. (Comment) The proposed studio is directly connected to the existing residence. As such, it should be filed as a separate permit from the new proposed dwelling. Clarify whether the art studio is intended to be a commercial or retail space, in which case, a commercial standard development package may be required. C3 zoning allows home occupation use as long as it is in compliance with use-specific standards 4.9.7.D-E: https://codelibrary.amlegal.com/codes/tucson/latest/tucson_az_udc/0-0-0-2638. 4. (Comment) Clarify the use of the new proposed dwelling. This dwelling can be classified as either an accessory dwelling unit (ADU) or full second dwelling. These are different uses that abide by different regulations from each other. Per UDC Section 6.6.3, an ADU is permitted to be up to 75% the size of the principal dwelling, can be up to the height allowed by the underlying zoning (in this case, up to 25’), can be attached or detached to the principal dwelling, is only required to have 5’ setbacks to the side property line, and would not require additional vehicle parking. A full second dwelling would not be restricted in size (the lot itself would be restricted to a 75% maximum lot coverage limit), could be up to 25’ in height, would have to abide by setbacks of 10’ or ¾ the height of the adjacent wall (whichever is greater), and would need to provide one vehicle parking space. 5. (Comment) The minimum required setback to the eastern property line cannot be determined without a confirmed from-design-grade height measurement. That said, it appears to be a 0’ setback. An ADU would require at least 5’ and a full second dwelling in an O3 zone would require at least 10’. In addition, the setback to W 18th St is 10’. While no setback distance is shown, it appears to be 4’ 8” (less given the protruding walk-up stairs), consistent with the existing structure. A Design Development Option (DDO) can be requested to reduce the minimum setback to 1’. A setback between 0’ and 1’ cannot be requested through a DDO and would require a Board of Adjustment variance.
