COMMENTS: Resubmit revised drawings along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

This site is located in the R-1 zone (UDC 4.7.8). A single-family residence is a permitted use in this zone (Table 4.8-2) subject to Use Specific Standards 4.9.7.B.5 – 9.

1. It does not appear that the owner listed on the setback waiver is correct. Per the Pima County Assessor’s Office information the owner of this property is Montano Geovana. If there has been a recent sale of the property provide documentation for the new owner. Perimeter yard setbacks are based on a wall height measurement from design grade to the highest point of the exterior wall UDC Article 6.4.5.B & Figure 6.4.5-A. Where the wall meets the eave of the roof at its highest point. As this dimension was not provide Zoning has use the 14’ dimension provided on sheet 4 less the 1’ for the proposed 2 x 12’ rafters for a wall height of 13’-0”. Per UDC Table 6.3-2.A the minimum setback to the interior property lines, west, is the greater of six (6) feet, or two-thirds (2/3) the height of the structure’s wall. Based on the 13’ height mentioned above the required perimeter yard setback to the west property line is 8’-8”, proposed setback is 6’-0”. At a minimum, a neighbors setback waiver is required. To secure this neighbor setback waiver the following statement must be provided on the plot plan and be signed and dated by the adjacent property owner(s):

If you are not able to secure this waiver from the owner this reduced setback can be included in the Board of Adjustment.

2. Per UDC Article 6.6.3.D Accessory structures, except for accessory dwelling units, shall not exceed 12 feet in height, unless attached to a principal structure. Proposed height of the proposed workshop is 12’-6”. A Board of Adjustment for Variance will need to be submitted and approved prior to approval of this permit.
