| 12/19/2024 | Site Zoning | REQUIRES RESUBMIT | FROM: PDSD Zoning Review Section PROJECT: TC-RES-1124-06636 4809 E 3RD ST. – R-1 Workshop (1st Review) TRANSMITTAL DATE: December 19, 2024 COMMENTS: Resubmit revised drawings along with a detailed response letter, which states how all Zoning Review Section comments were addressed. This site is located in the R-1 zone (UDC 4.7.8). A single-family residence is a permitted use in this zone (Table 4.8-2) subject to Use Specific Standards 4.9.7.B.5 – 9. 1. Provide a residential plot plan that meets the requirements found at: https://www.tucsonaz.gov/Departments/Planning-Development-Services/Permits/Plan-Examples/Plot-Plan-Example, to include but not limited to: a. The plot plan shall be drawn at an engineering scale, i.e. 1” = 10’, 1” = 20’.The property dimensions are not correct. Per the Swan Way Addition final plat found at: https://maps-and-records.tucsonaz.gov/subdivisions/search?book=07&pg=082, the north/south dimension should be 161.94’ and the east/west dimension should be 68’. b. Per the Swan Way Addition final plat there is a 10’-0” utility easement that runs along the north property line. 5’ on you property 5” on the property to the north show the easement on the plot plan. c. Provide a lot coverage that meets the requirements of UDC Article 6.4.3 and the example shown on the Residential Plot Plan Requirements. d. Provide the owners name on the plot plan. e. Provide the legal description, “SWAN WAY LOT 11 BLK 8” on the plot plan. f. Indicate the zoning of this parcel and all adjacent parcels on the plot plan. The zoning should be R-1 for this parcel and all adjacent parcels. 2. Perimeter yard setbacks are based on a wall height measurement from design grade to the highest point of the exterior wall UDC Article 6.4.5.B & Figure 6.4.5-A. Where the wall meets the eave of the roof at its highest point. As this dimension was not provide Zoning has use the 14’ dimension provided on sheet 4 less the 1’ for the proposed 2 x 12’ rafters for a wall height of 13’-0”. Per UDC Table 6.3-2.A the minimum setback to the interior property lines, west, is the greater of six (6) feet, or two-thirds (2/3) the height of the structure’s wall. Based on the 13’ height mentioned above the required perimeter yard setback to the west property line is 8’-8”, proposed setback is 6’-0”. At a minimum, a neighbors setback waiver is required. To secure this neighbor setback waiver the following statement must be provided on the plot plan and be signed and dated by the adjacent property owner(s): My Name is____________________ and I am the owner of the property located at_______________________. I have reviewed the site plan and I have no objection to structure being located or constructed________ feet from the property line as depicted on the site plan. Signature: _____________________________ Date: _________________________________ If you are not able to secure this waive a Design Development Option (DDO) will need to be submitted and approved or relocate the show to meet the required setback. Per UDC Article 6.6.3.D Accessory structures, except for accessory dwelling units, shall not exceed 12 feet in height, unless attached to a principal structure. Per UDC Article 6.6.4.a Measurement of Building Heigh is the vertical distance measured from the design grade elevation to the middle (between the eave and ridge ) of the highest gable of a pitched roof: (See Figure 6.4.4-A, Measurement of Building Height .) Provide a dimension from design grade to the midpoint of the roof. If this dimension exceeds the allowed 12’ height a Board of Adjustment for Variance will be required. Zoning was not able to find approved permit documents for these structures and permits would be required. Either provide approved permit documents or include them in this permit. If you choose to include them in the permit, full building plans well be required. Also provide perimeter yard setbacks and heights.
